Bandar Mahkota Cheras access: Dramatic saga!

KAJANG: An injunction to stop Cheras-Kajang highway concessionaire Grand Saga Sdn Bhd from erecting a barricade on the access road to Bandar Mahkota Cheras was filed at the High Court yesterday by Serdang MP Teo Nie Ching.

Teo said she filed the application on behalf of Segambut MP Lim Lip Eng after he was hurt in a fracas with the police on Thursday night.

Teo said she felt it was wrong for Grand Saga to use the police to help in re-erecting the barricade. Earlier, the residents had dismantled the barricade to use an access road to the highway without paying toll.

"Don't stir people's feelings as they (Grand Saga) suffered only financial losses," she said.

Teo said she filed the High Court application at 9am, when accompanied by her lawyer, Yap Boon Haw.

"We're waiting for the court to give us a date for the hearing," said Teo who added that the Selangor government should take action over the issue

Meanwhile, Lim said he would file a civil suit against the police following Thursday's incident.

Lim said he was pepper- sprayed, kicked and punched by a group of plainclothes policemen.

Seri Kembangan assemblyman Ean Yong Hian Wah then took Lim to a nearby clinic in a car. Lim said the pepper spray caused a "burning in my eyes, mouth and ears."

Lim said the highway concessionaire had no right to put up a barricade on the land as it belonged to the state government.

On Thursday, Barisan Nasional Backbenchers Club chairman Datuk Seri Tiong King Sing said the developer of Bandar Mahkota Cheras, Narajaya Sdn Bhd, should be brought to court and the residents should not reopen the road themselves.

Tiong said the developer had breached several conditions in its agreement with Grand Saga, causing the concessionaire to block the access road.

Tiong, who said Grand Saga had briefed him on the agreement with Narajaya Sdn Bhd, added: "The developer had breached some of the conditions, including a compensation pay-out to the concessionaire."

Among the conditions that Narajaya has to meet are the maintenance costs imposed by Grand Saga and compensation for losses incurred due to residents' use of the access road.

"Only the court can give an order to reopen the road and the Selangor state government should not interfere in this," said Tiong.

He said Ean Yong, who is a Selangor state executive councillor, should not blow the matter out of proportion by asking the residents to fight for their rights.

Grand Saga Sdn Bhd could not be contacted for comments yesterday.

Could State govt initiate investigation on the disposal of Grand Saga shares by Selangor state-owned Kumpulan Perangsang Selangor in 1999/2000. I could not understand why KPS would dispose a cash cow then. KPS used to own 42% of Grand Saga
