http://www.petitiononline.com/freemano

Kerajaan pusat bertanggungjawab jikalau PRK Kota Alam Shah diadakan kerana perletakan jawatan M. Manoharan

21 charged with illegal assembly

By The Sun Tan Yi Liang

PETALING JAYA (Jan 23, 2009) : Authorities today charged 21 people at the Sessions Court here with one count of illegal assembly and one count of defying a police order to disperse during an anti-ISA candelight vigil last year.

The group, which included PJ Utara MP Tony Pua, Pandamaran assemblyman Ronnie Liu, Kampung Tunku assemblyman Lau Weng San, MPPJ councilor Tiew Wei Keng, and Catholic priest Fr Paulino Francesco Miranda, all claimed trial to the charges.

They were allegedly to have committed at an anti-ISA candelight vigil at the MBPJ compound in Petaling Jaya between 9pm to 10.10pm on Oct 9 last year.

The participants of the vigil, which was organised by the Coalition for Clean and Fair Elections (Bersih), were charged under Section 27 of the Police Act.

If found guilty, they can face up to one year in jail, RM 10,000 in fines or both.

In making submissions for bail, Deputy Public Prosecutor Noordin Badaruddin asked the court to set RM5,000 as bail for each accused, and requested for their travel documents to be impounded by the court.

However, this was rejected by the defence, led by Puchong MP Gobind Singh Deo, who called them to be released on personal bond or for a lower bail of RM500 to be set as there was no violence or property damage caused by the accused.

"What is their offence? Their offence was taking part in an assembly, and ignoring the orders of Supt Mohd Shukor to disperse. There was no mention of violence in the offence," said Gobind

"What was done by the accused was their right under the Federal Constitution," said Gobind, who said the charging of the 21 was a black mark in the Malaysian legal system.

"These people merely exercised their constitutional rights to freely assemble, and they are now charged. What is so serious about this offence that it requires such a high bail? They have done nothing which deserves punishment by a high bail amount," said Gobind.

He told the court that the accused posed no flight risk.

"All of them made themselves present today in court, with no problem, and they are prepared to face the prosecution," said Gobind, who then cited authorities to show that there was no legal provision to detain the passports of the accused.

This view was shared by the other defence counsel, Segambut MP Lim Lip Eng, Salim Bashir, Sreekant Pillai, Francis Pereira and Chetan Jemwany, who each cited authorities to persuade the court to allow a lower bail of RM500 for the accused.

This was countered by Noordin, who argued that the court had the jurisdiction to impound the passports of the 21 accused as a bail condition and set a bail of RM 5000, and cited case law saying that such actions were an "assurance" to guarantee the attendance of the accused for trial.

"What I wanted to say, is that the request for bail is to ensure that their presence in court is ensured. That is the most important consideration that the court must consider," said Noordin.

After hearing submissions, Sessions Court Judge Balqis Aini Mohd Ali set bail at RM1,500 with one surety and set March 10 for mention.

Agree to RPK

RPK is proposing a change of strategy to repeal ISA after having candle light vigils almost every weekend.

I think his idea is a good idea, particularly when we need to spread the message to the general public. Certainly, we cannot afford to lock the message among the 200 people who attend the vigil.

RPK proposes that the five state Pakatan Rakyat state governments should put the money where their mouths are. He even goes ahead to propose to put up signboards or billboards in the state to spread the message.

I agree with him. It is time for us to be on the offensive side. After all, to be offensive is always the best defense. This is even true when Pakatan Rakyat won the Kuala Terengganu by-election, we need to deepen our charges against UMNO and BN.

Let's work harder to deliver the final nail into their coffin. As I always said, their days in Putrajaya are numbered.

Time to send the final blow to BN

From New Straits Times:
Seputeh MP Teresa Kok has confirmed that a molotov cocktail was thrown into her parents' house at Jalan Ipoh early this morning by unknown attackers.

No one was hurt in the 2.55am incident as the petrol bomb did not explode, said Sentul district police chief ACP Zakaria Pagan. At the time, Kok’s parents and younger sibling were at home.
From Utusan Malaysia:
KUALA LUMPUR 27 Sept.

Certainly, somebody is trying to divide the attention on ISA again, but behaving violent with the ill intention of stirring up fears and feeling of hatred among Malaysians.

Malaysians should be glad that all of us have stand together against the unlawful detention of Raja Petra Kamaruddin, the five Hindraf leaders and other ISA detainees when about two thousands peaceful demonstrators gathered in Kuala Lumpur to attend a candle light vigil against ISA.

The current federal government is in total disarray. I do not want to use the word "government" only as it will create unnecessary confusion when people could interpret the word "government" as "state government". When I am part of the Selangor state government, and that the Selangor state government is led by Pakatan Rakyat, not Barisan Nasional, therefore, it should always be made clear that the government I mean here is Federal Government.

At times when the economy of the country is directionless and when the country needs more effort and attentions from the ruling coalition to turn around the economy, the heads of government are only interesting in swapping positions and securing ways to strengthen their position in UMNO.

BN is like a sinking Titanic. BN is like a little sampan in the middle of the ocean without compass. Malaysians will sink togather with BN if BN were to hold on to power. It is now time to send the final blow to BN.

"Super" Minister Hamid Albar...

Yesterday, Home Minister Datuk Seri Syed Hamid Albar slammed Deputy Minister in the Prime Minister Department, Senator T. Murugiah who is in charge of Public Complaint Bureau (PCB) for the latter's statement he made when he attended to YB Teresa Kok's complaint about the poor food quality when she was under ISA detention from 12th September to 19th September 2008.

Syed Hamid Albar behaved as if he is the Super Minister. Although focus should be placed on the abolishment of Internal Security Act (ISA), I applaud Senator T. Murugiah who overseas PCB to immediately look into the matter.

It has been a convention for Cabinet Ministers under Westminster System of not to interfere portfolio of other ministers. However, in this case, Syed Hamid should look at the larger issue and not fence off criticisms especially criticisms from his BN counterparts.

How to show your support to RPK?

A man who has stood up for truth and justice in Malaysia has now been incarcerated for two years without trial and with no hope for release, save at the pleasure of our Home Minister.

The time has come for Malaysians to stand up and be counted; to send a signal both to the authorities that we will not be cowered and that we stand by our man; to send a signal to each other that we are not alone, and to show our strength to one and all.

The time has come to act.

We compile here a number of actions that every Malaysian citizen can do in protest of the ISA, and to express their hope for a better Malaysia. It is imperative in this crucial moment that we keep up the momentum, lest RPK be forgotten like the rest of the ISA detainees.

1. Fly the Malaysian flag anywhere and everywhere possible (car, house, desk, body)
2. Drive with your headlights on in the day
3. Go bald (send pictures to MT Team)

There are a number of other activities that can also be done, all of which will help RPK:

1. Wear Free RPK T-shirts (coming soon!)
2. Hold Candlelight vigils (send pictures to MT Team)
3. Sign online petitions (click
here to sign)
4. Flood the authorities with phone calls, faxes, etc (click
here for more details)
5. Send greeting cards to ISA detainees in Kamunting

notes:

* email MT Team : admin.mtoday@gmail.com
* postal address of ISA detainess : Y.M. Raja Petra Kamarudin, Tempat Tahanan Perlindungan, 34600 Kamunting, Taiping, Perak.

Head-Shaving Ceremony: Call for ISA to be reviewed and repealed

For more photos, please click here.

(The Sun) KUALA LUMPUR, 18 DAP members shaved their head bald to protest the detention of Malaysia-today.com webmaster Raja Petra Kamarudin and all other ISA detainees.

"We want the ISA repealed and all ISA detainees freed," said Segambut MP Lim Lip Eng who led the gathering of about 100 members.

Also present was Kampung Tunku assemblyman Lau Weng San. The protesters, aged between 11 and 61, including women, gathered at the Kuala Lumpur Selangor Chinese Assembly hall at 10.30am and took turns to lose their their "crowning glory".

Describing the 18 participants as "defenders of justice", DAP stalwart Lim Kit Siang said 10 years ago a similar vow was carried out at the same venue when his son and Penang Chief Minister Lim Guan Eng was jailed under the Sedition Act.

"We are here to demonstrate and object the use of ISA and to demand the release of ISA detainees especially the country's No. 1 cyber warrior Raja Petra." he said in his speech.

Lip Eng said he has sent a letter to Home Minister Datuk Seri Syed Hamid Syed Albar to adhere to the a statement made by the Human Rights Commission of Malaysia (SUHAKAM) urging the government to review the ISA.

Referring to a news report dated Sept 16, he said Suhakam had found the ISA as an outdated law and it's use was a breach of human rights.

"We urge the Home Minister to take heed of Suhakam's findings as on April 24, 1999, it was he who had announced that the government was ready to form the commission. Hence, Suhakam is his baby and he should pay attention to what they have to say," he said.

Among those present at the event was Seputeh MP Teresa Kok who was released on Friday a week after being held under the ISA, Raja Petra's wife Marina Lee Abdullah, Kelana Jaya MP Low Gwo Burne and several other DAP MP's.

Mansuhkan ISA or Mansuhkan BN!

Teresa is finally released but Raja Petra Kamaruddin and other ISA detainees including YB M. Manoharan and his four other counterparts are still detained under the draconian act.

While we can happily welcome the release of Teresa Kok, the continued detention of Raja Petra Kamaruddin, Hindraf 5 leaders and others under ISA only strengthen our will and strength to abolish ISA.

In fact, there is nothing much for us to celebrate except for the release of Teresa Kok. We should not even talk about celebration as if the struggle to abolish ISA has already succeeded. The release of Teresa Kok as well as the release of Tan Hoon Cheng are just a small step towards the abolishment of ISA.

Malaysians of all races and religions must now come together to get rid of ISA. We certainly do not want to see our next generations to continue to live under threat with the existence of ISA.

Malaysians shall not forget that there are currently bloggers charged under Sedition Act, which is also another draconian act. Newspapers (Sin Chew Daily, The Sun and Suara KeADILan) are served with show-cause letters under the provision of Printing and Press Act, which is another act that stiffen freedom of speech. The Home Ministry has yet to take any actions on the three newspapers.

The sword of devil is still at our neck.
