Jawapan kepada soalan bertulis DUN Bulan Ogos 2016: Projek penukargantian paip air

Berikut ialah jawapan bertulis yang dibekalkan kepada saya baru-baru ini terhadap pertanyaan bertulis yang dikemukakan saya dalam sidang DUN pada bulan Ogos 2016 yang lepas.

Soalan saya berkaitan dengan projek penukargantian paip air dan kerajaan Selangor menjawab bahawa kepanjangan paip sepanjang 59.5km yang dipecahkan kepada 12 projek berasingan akan mula ditukarganti pada tahun ini dan dijangka siap pada Disember 2017, sementara 11 projek berasingan berkepanjangan 85km (11 projek) telah dirancang untuk bermula pada tahun 2017 juga. Maklumat terperinci adalah seperti berikut.

Stephen Kalong Ningkam and his British expatriates

I came across a book accidentally in October 2014, entitled "The Struggle For Malaysian Independence", written by a retired police officer, Dato' J.J. Raj (Jr.). This book was also a personal accounts of a high-ranking PDRM officer serving the force during the early days of Independence and the formation of the Federation of Malaysia.

The book was published by MPH in 2007. One of the very interesting chapter to me is Chapter 16, which is about his posting as senior police officer in Sarawak from 1966 to 1972.

That was also one of the most turbulent times in the history of Malaysia and Sarawak, when the first Sarawak Chief Minister Stephen Kalong Ningkam was removed from his position as Chief Minister in 1966, followed by a series of legal suits, igniting one of the very first constitutional crisis in the history of Malaysia.

The cause of this crisis was the deeply entrenched distrust between Stephen Kalong Ningkam and Tunku Abdul Rahman as well as civil servants from Peninsular posted in Sarawak (the author included). 

According to the author, the very first agenda after the formation of Malaysia by the then Prime Minister Tunku Abdul Rahman was to localise the civil services of Sarawak and Sabah including and especially the state police services.

Tunku saw this as an important task as though Stephen was the first local Sarawakian Chief Minister, his entire civil service and administration, ie the state secretary, the state treasurer etc were in the hands of British officers, when these positions should progressively replaced by local Sarawakians. However, according to the author, Stephen Kalong Ningkam refused to do away with the services of British expatriates, three years even after the formation of Malaysia Federation.

Considering the fact that the book was published in 2007, long before the emergence of the Sarawak for Sarawakians (S4S) movement, I would hold that the views of the author, which was the first hand account of a person who had gone through those early days of the formation of Malaysia, are views that are not distorted to balance or counter the views of S4S.

Tax evasions by multinational companies

European Commission on Competition lately handed Apple a breathtaking demand for €13 billion (US$14.5 billion) to be paid to Ireland on the grounds that Dublin illegally favoured Apple with a tax regime that amounted toa competition-distorting subsidy.

Will Apple have any problem in paying it? Certainly no. Apple has a cash reserve of US$232 billion, of which US$214 billion are kept in foreign accounts. Apple's average profit per month in 2015 was about US$4.45 billion.

Why do companies like Apple wants to pay lower tax? Because they are going to reward their workers, employees and contractors better, such as those who worked extremely long hour in Foxconn's assembly plants?

Certainly no. So where does the monies go? Maybe it is good to ask Apple how much are they paying their CEOs and their top bosses.

I do not go against the business community, I am not a Communist because I believe the business community as well as the capitalists have their roles to play to move the economy forward. But as a global citizen, we must stand up in solidarity to go against them if they are evading their fair share of their taxes while at the same time paying peanuts to their workers and their contractors/workers. In another words, they are exporting poverty and slavery to the people of third world countries and importing huge profit out of exploitation into their own wallets.

高收入、高科技、高增值產業要從何談起呢？

最近國油解僱砂州子民，改聘西馬員工來砂工作，鬧得沸沸揚揚，甚至一度傳聞國油不惜讓西馬員工非法坐船登錄砂州某一個島嶼，當起“阿燦”了。

砂州子民不滿西馬官聯公司忽視砂州員工本來無可厚非，但是經一些團體的煽動，卻變成仇視西馬人，非常不健康。他們看不見或者選擇看不見一點事實——即原本欺壓和剝削砂州權益的其實就是過去50多年一直執政聯邦的國陣政府和他們在砂州的幫兇。

Termasuk beberapa soalan bertulis dan lisan seperti masalah denggi, rumah mampu millik, projek Langat 2, proses pengeluaran fatwa serta kesan Brexit terhadap Selangor. Ada lagi beberapa soalan yang telah dijawab semasa sidang DUN dan ada juga yang saya masih menunggu jawapan lengkap daripada pihak Eksekutif.

The arrest of a 76-year old senior citizen from Kampung Tunku shows Malaysia has gone down the path of freedom of expression

Media statement by DAP ADUN for Kampung Tunku Lau Weng San on 3rd July 2016 in Petaling Jaya:

Malaysians are outraged when Johore police yesterday arrested a 76-year old senior citizen was arrested in Kampung Tunku yesterday for an offence under section 233 of the Multimedia and Communication Act 1998. 

The senior citizen was arrested for allegedly sent an offensive image of Prime Minister Najib Abdul Razak under the name “Pa Ya” in the WhatApp group “Bicara Politik Melayu”. It seems to us that the oppressive nature of Najib’s regime has shown its true colour since the break out of his RM4.2billion scandal. 

Cabinet ministers, UMNO leaders and government officers including top law-enforcers who work against him are sacked and removed from their positions. Political dissents, social activists, artists and even ordinary Malaysians, in this case a 76-year old, are subject to intimidations, persecutions and selective prosecutions. 

It is sad and no doubt that freedom of expression in Malaysia has gone downwards.

Why tax breaks for Bandar Malaysia when millions of genuine Malaysians have to pay taxes?

Media statement by DAP ADUN for Kampung Tunku Lau Weng San on 30^th June 2016 in Petaling Jaya:

I find it enormously absurd when the Federal Government lately announced that there will be various tax breaks for Bandar Malaysia projects when millions of genuine Malaysian housebuyers and vendors have to pay various taxes when they transact.

The multi-billion ringgit Bandar Malaysia township is located at the old Sungai Besi Airport. The development is expected to house the Kuala Lumpur-Singapore High Speed Rail. The tax breaks include an eight-year waiver on stamp duties, Real Property Gains Tax and withholding tax.

In addition to that, the master developers and Bandar Malaysia subsidiaries will also enjoy a10-year income tax breaks and import duty exemption on selected construction materials.

Therefore, it is equally absurd when the master developers of Bandar Malaysia and its subsidiaries are entitled to various tax breaks while many other developers, many of them are medium-size developers are unable to enjoy such tax breaks.

"Sebelum dan selepas"

Sebelum PRN Sarawak, dia berjanji menurunkan lebih banyak kuasa kepada Sarawak sebelum PRU, malahan Adenan berjanji memberi jawatan TKM kepada wakil rakyat Cina/SUPP. 

Sebelum PRK Sungai Besar dan Kuala Kangsar, dia dengan diam-diam mengatur langkah liciknya. Pertama sekali dia mengugurkan Muhyiddin, Mukhriz dan Shafie daripada jawatan masing-masing, tetapi dia masih belum berani mengambil tindakan disiplin terhadap mereka. Malahan dia tidak berani sentuh Tun Dr Mahathir pun.

Selepas kemenangan besar PRN Sarawak dan kedua-dua PRK, PBB kehilangan satu jawatan Menteri Persekutuan, tiada jawatan TKM untuk SUPP, peruntukan untuk Pan-Borneo Expressway ditolak daripada peruntukan pembangunan infrastruktur Sawarak.

Sepang International Airport, Selangor.

Everytime when I depart from Sepang International Airport (or KLIA, so they named it), every time when I am asked when I depart from, whether I am taking a domestic or international flight, this is my answer - "Sepang". A guy once criticised my proposal to rename the airport as "Sepang International Airport". He said: "Is this meant to be an example of the Chinese adage: 'When business is bad, paint the front door.' Who gives a flying fingernail what the airport is called. Internationally it's known as KLIA and KUL and that is what it will always be known as. Your desperate attempts to boost the ego of Selangor is idiotic." He is certainly unhappy with my suggestion and he further said that my idea is idiotic. Idiotic it is? Not really until you realise that Selangor is the only state in this country that have carved out, not once but twice, its state land to the Federal Government as Federal Territories, first Kuala Lumpur and later Putrajaya. Not until you realise that Selangor is only paid annually RM25 million for the revenue losses from the two pieces of lands. You can't even build a decent hospital with RM25 million. Not until you realise that the Federal Government has far more constitutional power in this country as compared to every state government, Sabah and Sarawak included even when they pride themselves with autonomy powers. And the list goes on...

“KLIA2”, “LCCT2” or “Sepang LCCT2”? Liow Tiong Lai not answering AirAsia’s concern.

Media statement by DAP ADUN for Kampung Tunku Lau Weng San on 23^rd June 2016 in Petaling Jaya:

  

I read with concern on a statement from AirAsia Chief Executive Officer (CEO) Aireen Omar dated 21^st June that the group would embark on a rebranding campaign to rename KLIA2 terminal to LCCT2.

Yesterday, Minister of Transport Liow Tiong Lai rebutted her that such request is “inaccurate, impractical and unnecessary”, citing the reason that the airport is already registed with the official code “KUL”. (The current IATA code for KLIA is “KUL”)

It is clear that the Minister has misinterpreted the proposal from Aireen Omar as what AirAsia proposes is a commercial exercise to rename KLIA2 as LCCT2. Aireen Omar has never stated that the aviation group is planning to change the airport code name with International Air Transport Association (IATA) or International Civil Aviation Organisation (ICAO).

While I have no question whatsoever on AirAsia’s proposal on the name change, the subject matter has sparked some debate on the rightful name of the two airports, namely KLIA and KLIA2 (or LCCT2), the authority must not again confuse foreigners with the word “Kuala Lumpur” when the airports are indeed located in Sepang, some 60km away from Kuala Lumpur.

BN Selangor harus menjadi pembangkang yang cekap sebelum beridaman untuk mengambil alih kerajaan Selangor

Kenyataan Media ADUN DAP Kawasan Kampung Tunku, Selangor, Lau Weng San pada 21 Jun 2016 di Petaling Jaya:

  

Sejurus selepas keputusan Pilihanraya Kecil (PRK) untuk kawasan Parlimen Sungai Besar dan Kuala Kangsar, banyak spekulasi dan kenyataan daripada kem dan jentera Barisan Nasional (BN) Selangor bahawa mereka yakin dan mampu untuk mengambil alih kerajaan Selangor pada Pilihanraya Umum (PRU) yang akan dating.

Sebelum BN Selangor beridam untuk mengalahkan Pakatan Harapan dalam PRU yang akan dating, BN Selangor perlu membuktikan terlebih dahulu kepada rakyat dan pengundi di Selangor bahawa BN Selangor merupakan pembangkang yang berkredibel dan berkesan serta efektif.

Maka untuk menjadi pembangkang yang berkesan, BN Selangor perlu melakukan perkara-perkara seperti berikut:

1.    Mengisi segera jawatan Ketua Pembangkang Dewan Negeri Selangor yang sekian lama dikosongkan akibat perletakan jawatan penyandangnya yang terdahulu, Datuk Mohd Shamsudin Lias, ADUN Sungai Burung.

2.    Menjadi Pengerusi Jawatankuasa Kira-kira Awam (PAC) DUN Selangor sekaligus memenuhi keperluan Peraturan-peraturan Tetap Dewan Negeri Selangor dan tradisi Komanwel.

3.    Menerimapakai peruntukan kawasan sebanyak RM200,000 setahun yang ditawarkan oleh kerajaan Selangor sejak tahun 2015. RM200,000 ini merupakan satu permulaan ke arah mengiktiraf sumbangan wakil rakyat pembangkang terhadap pembangunan negeri.

Adalah diketahui umum bahawa pembangkang di DUN Selangor yang diterajui oleh UMNO Selangor telah menolak ketiga-tiga tawaran di atas kerana budaya politik UMNO yang masih ketinggalan zaman.

Kempen DAP di PRK Sungai Besar

Ramai wala'un PAS memperlekehkan Parti Amanah sebagai bergantung kepada DAP dan PKR dalam kempen PRK ini. Benar atau tidak?

Memang tidak kerana membantu rakan seperjuangan ialah komitmen dan tanggungjawab DAP kepada Pakatan Harapan (sekarang) dan Pakatan Rakyat (dahulu).

Atas semangat setiakawan dan berpasukan, memang DAP dan PKR wajib membantu rakan sepasukan dalam setiap pertarungan, apatah lagi DAP menang di DUN Sekinchan sejak tahun 2004.

夢醒砂朥越

砂州選舉是民主行動黨開拓新疆野的新嘗試。這是一條不歸路，也是正確的道路，其目的就是要打倒腐敗的國陣政權！不管這次砂州行動黨在鄉區或半城鎮全軍覆沒還是稍有斬獲，行動黨開拓全馬各地的鄉野疆土將是一個沒有回頭的道路。

十年河東十年河西。十年前當我第一次抵達古晉助選時，行動黨的目的只是鞏固城市選區，沒人料到十年後的行動黨會委派土著候選人出戰高達16個州議席。縱觀行動黨的歷史，至少在砂拉越，這應該是史無前例。

這一切始於2013年505大選。行動黨在一片烏巴風潮拿下高達38個國會議席，雖然民聯獲得多數票增加，但是伊斯蘭黨和公正黨的議席卻減少。有人歸咎於馬來票回流國陣，但是我認為這個現象並不普遍發生。例如在雪州，我們該如何解釋伊斯蘭黨的議席會暴增。唯一能夠接受的看法是，馬來人政治需要一個強人政治。

只要在野黨有強人取代巫統，那麼改朝換代指日可待。當時的雪州，州務大臣卡立形象良好，民聯三黨一團和氣，在野黨巫統連一個稱職的州務大臣人選也退不出來，注定失敗！

自2008年政治海嘯以來，行動黨已經栽培一群年輕或忠於行動黨政治鬥爭的非華裔候選人。這批候選人自2011年砂州州選多次參與選舉，雖然直至今天尚未贏獲任何議席，但是他們屢敗屢戰，越戰越勇。行動黨必須努力栽培這群政壇生力軍，提供充足的養分讓他們在政壇能夠繼續大展拳腳。

此次砂州州選是首長阿德南第一次以首長身份出戰。本著新首長效應下的高民意，加上民主行動黨此次第一次攻打鄉區選區，此次州選一開始對行動黨就是一場硬戰。行動黨在此次州選不僅無法在鄉區有所斬獲，同時也痛失原有的五個城市選區的議席。原因為何？眾說紛紜。我認為每一個原因都造就行動黨的敗局。

人在適耕莊海口漁村

我昨晚在適耕莊海口演講。提到兩名即將被釋放的海口漁民，我認為如果聯邦政府有心要幫忙，他們絕對可以更早就解決這個問題，不必等到補選。

今年4月1號，8名菲律賓南部武裝分子乘坐快艇，在沙巴東岸利吉丹島附近海域騎劫4名來自砂朥越詩巫的4名華裔船員。

因為有砂朥越州選舉，加上贖金最後期限逼近，家屬當時非常焦急四處募款籌贖金，結果國陣的高官礙於選舉需要，被迫立即處理。

適耕莊的漁民被印尼執法當局逮捕的事情發生在今年農曆年初三。8艘來自大馬的漁船遭印尼海上執法單位扣押，其中7艘來自霹靂州半港漁村（注：半港隸屬副首相阿末查希選區）， 一艘來自適耕莊海口。

適耕莊漁民事件發生比詩巫四名人質事件還要早，可是4月剛好是砂州選舉，適耕莊沒有選舉或補選，所以被擱下來。

布迪曼在依刑法立場兜兜轉轉，甚至開空頭支票，馬華應立即暫停助選。

雪蘭莪州民主行動黨甘榜東姑區州議員劉永山於2016年6月7號在雪州大港所發表的文告：

布迪曼昨天在記者會針對伊斯蘭刑事法（依刑法）應該明確表達立場和看法，而不是一直在轉圓圈，更加不能說勝選之後再來談。布迪曼這麼說意味他要求華裔選民先開一張空頭支票給他。這樣的講法非常不負責任。

馬華和民政黨應該要求布迪曼把立場和態度講清楚，而不是含糊其辭。或者馬華和國陣的領袖應該清楚地問布迪曼和巫統，倘若伊斯蘭黨在下次國會再次提呈的動議要求修改法律增加伊斯蘭法庭的權限，巫統和布迪曼（假如他中選）在國會會否支持這個動議？

馬華和民政應該問無痛和布迪曼，既然有部分意見認為伊斯蘭黨的動議並不是依刑法，這意味穆斯林未必要支持這項動議，請問無痛和布迪曼還有沒有必要支持這項動議？

布迪曼和巫統在這事情無法說清楚，讓華裔選民開始懷疑巫統走的路線就是伊斯蘭黨的路線。同樣的依黨領袖的風格其實就是再版的巫統。投巫統一票等於投伊斯蘭黨一票；相反地，投伊斯蘭黨一票等於投巫統一票。

伊斯蘭黨已經成為翻版巫統

雪蘭莪州民主行動黨甘榜東姑區州議員劉永山於2016年6月5號在雪州大港所發表的文告：

巫統走的路線就是伊斯蘭黨的路線。同樣的依黨領袖的風格其實就是再版的巫統。投巫統一票等於投伊斯蘭黨一票；相反地，投伊斯蘭黨一票等於投巫統一票。

即便是巫統部長納茲裡也調侃伊斯蘭黨，即該黨領袖的作風（高舉馬來劍、身穿馬來武士服裝出席黨代表大會）確實有跟風之嫌，讓人懷疑到底當下的伊斯蘭黨是否已經遺棄兩位依黨先賢聶阿茲和法茲諾倡導的“全民伊斯蘭黨”？

因此，教育部副部長兼馬青總團團長張盛聞指責國家誠信黨是翻版伊斯蘭黨，根本是歪論！反之，伊斯蘭黨體內的基因已經出現嚴重變化，體內流著綠色的血已經逐漸褪色變成藍色。當誠信黨不可能成為翻版伊斯蘭黨之際，伊斯蘭黨卻有可能成為翻版巫統。

歷史上，阿斯裡領導的伊斯蘭黨（1970年至1982年）曾經右傾，選擇以狹隘和極端的民族主義與巫統靠攏（當時伊斯蘭黨和馬華都是也是1974年成立的國陣成員黨之一）。因此伊斯蘭黨向巫統靠攏，並不是危言聳聽，而是曾經發生的事情。

反之，國家誠信黨（Amanah）的領袖在雖然大多隸屬前伊斯蘭黨的開明進步領袖，惟因為黨內保守派的打壓，已經離開伊斯蘭黨，另外籌組國家誠信黨。值得留意的是，這些中生代領袖是在伊斯蘭黨推翻右傾領導之後，即1982年以後才加入伊斯蘭黨。當時伊斯蘭黨主席是Yusuf Rawa，一位來自由來自霹靂州的宗教師。有趣的是，Yusuf Rawa也是現任誠信黨的全國副主席Mujahid的先父。

誠信黨就是在這個背景之下誕生於馬來西亞的政治舞台，以凝聚國內進步開明穆斯林的政治力量和填補進步伊斯蘭在馬來西亞政壇的空缺。行動黨以及廣大熱愛自由民主的非穆斯林更應該和這類穆斯林廣結善緣，以鞏固馬來西亞進步政治力量。

這個政黨和張盛聞口中的翻版伊斯蘭黨相差甚遠。反之，馬華在這場補選幫忙巫統助選，似有協助伊斯蘭黨，為虎作帳之嫌，畢竟伊斯蘭黨和巫統的政治光譜越來越接近。馬華幫忙巫統助選，除了一再證明馬華在國陣當家不當權之外，也證明馬華根本無法阻止巫統和伊斯蘭黨合作。

Federal Government should not be keeping KIDEX alive as Selangor has given a definitive rejection in February 2015.

Media Statement by Rajiv Rishyakaran, Yeo Bee Yin, Lau Weng San and Ng Sze Han, ADUN for Bukit Gasing, Damansara Utama, Kampung Tunku and Kinrara on Sunday, 29th May 2016

The recent admission1 by Works Minister Datuk Seri Fadillah Yusof that Putrajaya is not only considering the Petaling Jaya Dispersal Link (PJD Link) but has also extended the Kinrara Damansara Expressway (Kidex) is unprofessional and unfair on the residents in Petaling Jaya.

After much deliberation, and to much anxiety to the residents in Petaling Jaya, the Selangor government set a definitive dateline of 14th February 2015 for Kidex to meet all the requirements, of which they have failed to do so.

Rightfully so, Menteri Besar Azmin Ali subsequently announced2 that Kidex is cancelled, and that put the rest one and a half year of anxiety by residents of Petaling Jaya. In line with this, Kidex was also not included in the recent amendment exercises to the Petaling Jaya Local Plan.

Putrajaya should not have extended the concession agreement of Kidex in light of the clear no from Selangor. In doing so Putrajaya has shown great disrespect to the Selangor Government and the people of Petaling Jaya.

承認統考文憑只剩下“一里路”還是“億里路”？

雪蘭莪州民主行動黨甘榜東姑區州議員劉永山於2016年5月28日在八打靈再也所發表的文告：

  

我促請馬華總會長拿督斯里廖中萊及教育部副部長張盛聞，針對教育部長拿督斯里馬哈基爾在國會的宣布，統考不符國家教育政策的立場給華社和華教界人士做出明確的立場表態。

教育部長馬哈基爾表明，所有在大馬落實的教育制度，必須符合《1996年教育法令所列下的教育政策，即以國語作為主要教學媒介語和采用國家課程綱要与考試，因此統考文憑被視為不符合國家教育政策的需求。

隨着教育部長在國會的正式聲明，是否意味着國陣政府已經正式拒絕承認統考文憑？早在去年11月，高教部副部長拿督葉娟呈也曾表明，聯邦政府的立場不變，不會承認獨中統考資格。

身為副教育部長的張盛聞既然早已經掌握該部与部長在國會所要表達明確的政策立場，為何還要說聯邦政府承認統考文憑僅僅剩下最後“一里路”呢？到底這“一里路”是不是變成“億里路”？

“吉隆坡”國際機場應該正名為雪邦國際機場

雪蘭莪州民主行動黨甘榜東姑區州議員劉永山於2016年5月26日在八打靈再也所發表的文告：

我對馬來西亞機場控股有限公司日前計劃推出吉隆坡國際機場航空城（KLIA Aeropolis）的計劃表示關注。據稱這項計劃在未來15年為國內生產總值帶來300億令吉的貢獻，以及製造超過5萬6000個就業機會。

聯邦政府不應該以“吉隆坡”這個字眼來混淆外國人，因為所謂的“吉隆坡國際機場”根本不是位處吉隆坡市內，而是離開吉隆坡超過60公里的雪蘭莪州的雪邦縣。

No more “Kuala Lumpur” International Airport but Sepang International Airport

Media statement by DAP ADUN for Kampung Tunku Lau Weng San on 26^th 2016 in Petaling Jaya:

I read with concern the news that Malaysia Airport Holding Berhad (MAHB) is planning to launch Kuala Lumpur International Airport (KLIA) Aeropolis, which is expected to contribute RM30 billion to the gross domestic product (GDP) and more than 56,000 jobs over the next 15 years.

The authority must not again confuse foreigners with the word “Kuala Lumpur” when the airport and the proposed location of the aeropolis is indeed located in Sepang, some 60km away from Kuala Lumpur.
