Lau: No money loss for Talam deal

THE Selangor government does not risk losing any money owed to it by Talam Corporations Bhd (now known as Trinity Corporation) even if the land valuation prices does not match the prices for which the lands were acquired from Talam, a state assemblyman said yesterday.

Kg Tunku assemblyman Lau Weng San said that since all the deals are underwritten between Talam and the state, Talam would still need to find extra parcels of land to dispose off to Selangor if the state could not retain RM392 million worth of lands from the exercise.

"The question about land valuation (and overpayment) is of secondary consideration. This is because there is an undertaking that Talam still needs to find more land so that the state recovers the full sum of RM392 million that is owed to state by Talam," he said during a press conference here yesterday.

Lau made available copies of hansard dating back to July and November 2010, saying that Menteri Besar Tan Sri Abdul Khalid Ibrahim had already answered many of MCA Young Professionals Bureau Chairman Datuk Chua Tee Yong's questions during the state legislative assembly almost two years ago.

The hansard shows Abdul Khalid as saying that the state plans to increase value on the lands it had acquired from Talam by zoning the land as commercial before selling them off based on gross development value.

"What Chua has done is that he had basically subtracted the difference the professional valuation for the price of lands and the gross development value. That's the difference," Lau said, referring to a Talam circular to its shareholders dated March 15, 2011.

However, the assemblyman was unsure of who made the gross development valuation and on what basis the state had acquired the lands based on the gross development value rather than professional valuation.

Chua had earlier alleged that the state had overpaid (overvalued) by RM 57.3 million to Talam for a piece of land in Danau Putra and RM42 million for another piece of land in Bestari Jaya.

"For that (clarification) we need to wait for the white paper," Lau said.

However, Lau alleged that Chua had been "selectively reading" from the hansard when the latter criticised the state government for not producing a white paper on the deals that it supposedly promised by the end of 2010.

"The hansard record clearly states that (Abdul Khalid) will produce the white paper provided all the agreements are finalised and all transactions included. But, if the Talam circular to its shareholders was only sent in March 2011, the state couldn't possibly produce a white paper before that," he said.

The Talam circular was the company's seeking of its shareholders' consent to go ahead with the deal to offset its debts with the state.

Lau also rebutted Chua's claims that lands submerged in water has less value, pointing out the Sunway Lagoon theme park and The Mines shopping mall were both built on excavated mining ponds.

Selangor MB Khalid Ibrahim's 'silence' over the White Paper on Talam is because he has made his statements in the State Legislative Assembly.

PETALING JAYA: MCA’s “selective” deciphering of the Selangor Legislative Assembly’s Hansard to gain mileage over the alleged Talam Corporation scandal has come under attack.

DAP-Kampung Tunku assemblyman Lau Weng San said that MCA’s Labis MP Chua Tee Yong chose not to reveal the full contents of the Hansard when making his allegations.

Lau implied that if Chua had done that, he would have gotten his answers over Talam.
“Chua Tee Yong is selectively using the Hansard to suit his political taste.

“…There are answers in the Hansard but he has conveniently ignored it,” he told reporters at DAP’s Selangor headquarters.

Armed with copies of the Selangor Hansard, Lau said that the question of over-payment for Talam land should have never come up.

Citing Selangor Menteri Besar Khalid Ibrahim’s statement on July 13, 2010, Lau said that the money earned from Talam’s land handover should not be less than RM392 million which is Talam’s debt to Selangor.

“In other words, the issue of over-payment, which is the result of subtracting gross consideration value from professional valuation, does not arise because Talam has already undertaken to settle the debt in full,” he said.

Lau added that the state government “may eventually” consider selling its newly-gained lands based on a “gross development value” for profit.

“Since Talam has already agreed to settle the matter in full…you must get RM392 million from Talam,” he said.

MB’s anwers in Hansard

Lau also said that Khalid’s supposed silence over the White Paper and the whole issue was because the MB had answered the matter in the State Assembly before.

Reading from the July 13, 2010, Hansard, he said that the Talam White Paper needed to take into account all the agreements affected by Talam’s debt settlement.

He said that the White Paper could not possibly have been released by the end of 2010, despite the MCA’s insistence, when even Talam’s circular to its stakeholders (via Bursa Malaysia) only came out on Mac 15, 2011.

Previously, Khalid had said that the state government did not come out with the White Paper as some of its matters with Talam had not concluded yet.

He also denied that Bursa Malaysia and the Securities Commission had no role to play when it came to Talam’s debt-restructuring.

Citing Bursa Malaysia Main Market Listing Requirements documents, he said that Bursa Malaysia’s endorsement in the matter was required, and the claim to exclude it was “surprising”.

Lau also attacked Chua for the latter’s claim that some of the land handed over to Selangor was underwater, implying that it was useless.
He said that major entertainment centres such as The Mines Wonderland and Sunway Lagoon were mining ponds at one time, and were redeveloped into successful ventures.

“A smart guy will turn the mining ponds into gold mines. A guy who is not so smart will see it as fishing ponds,” he said.

刘永山:雪议会纪录可获答案 斥蔡智勇选择性忽略


刘永山出示州议会纪录光碟,指卡立早在两年前的州议会上,已回答蔡智勇的疑问。

(吉隆坡24日讯)民主行动党甘榜东姑区州议员刘永山指责马华青年专才局主任拿督蔡智勇在雪政府与达南土地交易争议课题上,是在选择性引用州议会纪录来符合他的政治“口味”。

刘永山在记者会上表示,其实蔡智勇对该课题的质疑,早在两年前的雪州议会纪录上,就可寻获答案,可惜却被其选择性的忽略。他今日是针对蔡智勇指责雪州政府购买位于达瑙布特拉(Danau Putra)和八丁燕带(Bestari Jaya)两块土地,作出回应。

他指出,针对蔡智勇提问为何无法提呈白皮书,卡立于2010年7月13日的州议会上早已说明,虽预料在2010年尾,可将白皮书提呈给州议会,但卡立同时也提到,提呈白皮书前提是必须在所有合约准备妥当之下;而达南仅在2011年3月15日才交上股东通知书而已,所以蔡智勇要求雪州政府于2010年年尾交出白皮书,未免太强人所难。

“如果达南连征询股东同意也还未得到,要如何与州政府签约,那州政府又该如何提交白皮书。”

Selective quotes from the Selangor State Legislative Assembly hansard makes Chua Tee Yong a bad taste MP

MCA Member of Parliament of Labis, Johore, also Deputy Agricultural and Agro-based Industry Minister, Chua Tee Yong has been raising questions on a round-tripping exercise of Selangor State Government (SSG) to recover a hidden debt of RM392 million owed by Talam Corporation Berhad (now named Trinity Corporation Berhad) for the past ten years.

His major accusations circulated around SSG overpaid Talam Corporation on several land deals. Two examples are raised so far as below:
(1) An overpayment of RM57.3 million to Talam for a piece of land in Danau Putera and;
(2) An overpayment of RM42 million for another piece of land in Bestari Jaya.
Where is the White Paper?

He also claimed that some of these lands are submerged under water and have very little economical value. He also pushed for SSG to release a white paper as promised to be released in end of 2010. This is based on an extraction of Selangor State Legislative Assembly meeting on 13th July 2010 when Selangor Mentri Besar Tan Sri Khalid Ibrahim replied a supplementary question by BN State Assemblyman for Paya Jaras, YB Dato’ Ir Muhd Bushro Mat Johor.

Chua Tee Yong has been hammering Tan Sri Khalid Ibrahim since day one on his delay in issuing a White Paper, which he promised in the State Legislative Assembly, would be issued by end of the 2010.

If Tee Yong pays more attention to read what he has, I am sure he will be able to read this line from the hansard:
“Untuk ini, kertas putih yang dikehendaki mestilah dan ada agreement-agreement yang kita lakukan.”

Unfortunately, Tee Yong seems to be unable to understand this sentence as he keeps blaming SSG for its failure to produce the White Paper, knowing very well that not all transactions were concluded then in the end of 2010. This is even when Talam Corporation issued a circular to all its shareholders via Bursa Malaysia only on 15th March 2011, which is less than three months away from December 2010.

How on earth could SSG or Tan Sri Khalid Ibrahim issue a White Paper when Talam at that point of time had not even got the approval from its shareholders? Or is Tee Yong selectively quoting from the Hansard to justify his accusations?

The question of over-payment

Tee Yong also worries that taxpayers’ monies will go to drain when there are two records of overpayment from SSG to Talam. He also questions if SSG manages to fully recover RM392 million from Talam.

Tee Yong will definitely get his full answer if he has fully read the Selangor State Legislative Assembly hansard on 13th July 2010.

Tan Sri Khalid Ibrahim was saying in the hansard in page 19, that
“….dan dengan tanah-tanah itu kita beritahu Talam kalau kita tidak dapat lagi jumlah akhirnya tiga ratus Sembilan puluh dua juta kita ambil lagi tanah Talam yang lain.”
This means that if assets from Talam fail to yield RM392 million for the state government, the state government then has the right to take other lands owned by Talam to recover the remaining debt.

Tan Sri Khalid Ibrahim also said in the state legislative assembly the same day that,
“oleh kerana Kerajaan Negeri sekarang ada ketelusan saya juga dari semasa ke semasa mengedarkan harta-harta yang kita dapati dan berapa pula pendapatan daripada harta-harta ini dan pendapatan ini mesti jangan kurang daripada tigas ratus sembilan puluh dua juta ringgit. (Hansard, page 19)”
This means whatever revenue generated from the disposal or sales of any Talam’s properties held by SSG, the value shall not be less than RM392 million, which is the money owed to SSG by Talam.

In other words, the issue of over-payment (which is the result of subtracting gross consideration value from professional valuation) does not arise because Talam has already undertaken to settle the debt in full although the state government eventually may consider selling these lands based on gross development value to secure higher prices.

This is particularly true when Tan Sri Khalid Ibrahim stated in the State Legislative Assembly, also on 13th July 2010, that
“kerajaan negeri bercadang untuk meluluskan program prmbangunan tanah tersebut bukan cara jual tanah kosong tapi tanah yang sudah ada rancangan pembangunan building approval plan. Dan apabila kita jual, kita jual berasaskan gross development value. (Hansard page 19)”
Bursa Malaysia and Securities Commission has no role to play?

Talam issued a circular to its shareholders on 15th March 2011 named “Proposed settlement of debts amounting to RM391,986,473 by Talam Corporation Berhad to Menteri Besar Selangor (Incorporated) by way of disposal of properties and cash payment.”

Talam claimed that all exercises under the proposed settlement are endorsed and approved by Bursa Malaysia and Securities Commission. Chua Tee Yong refuted this claim and disagreed by saying that debt-restructuring of a public listed company (PLC) does not require approval from Bursa Malaysia and Securities Commission.

If what Tee Yong says is true, then he should explain the meaning of Clause 9.33(1) under Chapter 9 “Continuing Disclosure” of Bursa Malaysia Main Market Listing Requirements as below:
“9.33 Issuance of circular or document

(1) Where a listed issuer announces a corporate proposal (including a transaction) to these Requirements a circular or document is required to be issued to its securities holders in relation to such corporate proposal -

(a) the said listed issuer must submit the draft circular or document to the issue the circular or document as the case may be, in accordance with these Requirements as soon as possible and in any event not later than 2 months from the date of the announcement or the date the last approval necessary for the corporate proposal is obtained from the relevant authority, whichever is the later; and

(b) where the draft circular or document is submitted to the Exchange pursuant to subparagraph (a) above, the circular or document must be issued immediately upon receipt of the Exchange’s confirmation that it has no further comment and in any event not later than 14 market days after receipt of such confirmation.”

He should explain the meaning of this sentence which appears in most of the valuation reports by chartered valuation surveyors to Talam “we refer to your instruction to ascertain/access the market value of the…..for submission to Bursa Securities Malaysia by Talam Corporation Bhd for approval of its circular…”
So can we still now say that Bursa Malaysia has got no role to play in this exercise?

Land submerged under water has no economical values?

I do not have any idea what MBI plans to do with any land submerged under water which MBI recovers form this exercise but Tan Sri Khalid Ibrahim’s reply in the Selangor State Legislative Assembly throw a lot of limelights on various proposals that SSG received since then.

This is what he said in the Selangor State Legislative Assembly on 9th November 2010:
“…kita masih lagi menimbang keupayaan ini sebab kita dapati sekarang projek di Bukit Beruntung mula menarik ramai aaa...aa...pemaju-pemaju termasuk pemaju daripada Sime Darby melalui TESCO yang membina apa yang dipanggil, aaa...a...centre..pusat untuk menyimpan aaa...aaa..barang-barang yang akan dihantar ke pusat-pusat Tesco di seluruh negeri, negara, that mean gudang , gudang simpanan dan juga kita dapati juga pembangunan aa...golf ...city yang ingin membangun lebih daripada 50 lubang golf yang dibuat oleh Kumpulan yang menjayakan, apa yang dipanggil D...aaa...aa...D’Mines...saya tengah... Lombong...saya nak tulis Lombong tak boleh, Mines, saya tengah fikir apa nama, aaa...jadi kita belum buat keputusan lagi. Kita belum buat keputusan tapi yang penting ialah mengambil alih tanah-tanah ini. Malangnya, saya tak nak cerita panjang tentang ini, tanah-tanah ini dulu tanah kerajaan , kita bagi pada TALAM, tapi kita ambil balik, kita ambil balik dan tanah ini sekarang sudah dikuasai balik oleh Kerajaan Negeri (Hansard page 18-19).”
Let me remind Chua Tee Yong that The Mines was developed by Tan Sri Lee Kim Yew from the world largest excavated tin mine in Serdang. Let’s not forget Sunway Lagoon, also successfully redeveloped by Tan Sri Jeffrey Cheah’s Sunway Group from an ex-mining pond. Smart guys can increase the gross development value of mining ponds into gold mines instead of fishing ponds.

Sistem pengurusan hartanah Bumiputera yang telus dan cekap

Saya selaku ADUN Kampung Tunku dengan ini menyampaikan satu pemberitahu untuk memohon kebenaran ucapan penangguhan mesyuarat akhir persidangan di bawah Peraturan Tetap 16(2) pada 12 Julai 2012, di mana isi kandungan ucapan adalah seperti yang berikut:
“Kerajaan Selangor harus menetapkan satu sistem pemindahan hartanah lot Bumiputera yang telus dan efektif supaya pembeli rumah Bumiputera tidak terlalu dikongkong dengan peraturan-peraturan yang terlalu tegas di samping mengelak sebarang manipulasi.
“Contoh yang paling baik untuk menggambarkan situasi ini ialah dua aduan yang diterima berkenaan Kondominium Kelana D’Putera yang dibangunkan oleh Syarikat Perantara Properties Sdn. Bhd.

“Dalam kes pertama, seorang pemilik rumah Bumiputera yang juga seorang warga emas ingin melepaskan rumahnya kepada seorang kawan karibnya sejak zaman persekolahan lagi tetapi tidak berjaya kerana rumah beliau itu ialah unit kuota Bumiputera dan tidak boleh dipindah milik kepada pembeli bukan Bumputera.

“Dalam kes kedua, seorang pemilik rumah bukan Bumiputera telah dipesong oleh pemaju dan terbeli sebuah rumah kuota Bumiputera. Beliau ingin menjual rumah ini kepada seorang pembeli bukan Bumiputera tetapi tidak berjaya.

“Dalam kedua-dua kes ini, pembeli asal rumah berkenaan dilarang daripada menjual rumah kuota Bumiputeranya kecuali mendapat kebenaran daripada kerajaan Selangor. Proses ini memakan masa dan ini tidak mendatangkan apa-apa kebaikan baik kepada pemilik ataupun kepada pembeli.

“Apa yang jelas, memang terdapat ketirisan dalam system yang sedia ada sehingga terdapat pihak-pihak tidak bertanggungjawab mampu memanipulasi peraturan-peraturan yang ada untuk kepentingan mereka. Kerajaan Selangor harus berikhtiar untuk menyelesaikan masalah ini.

“Contohnya, pembeli Bumiputera harus diberi kebebasan untuk menjual rumah tersebut kepada bukan Bumiputera dengan syarat pembeli berkenaan perlu membayar caruman kepada satu tabung yang dikhususkan untuk membantu golongan miskin untuk memilik rumah pertama mereka.

“Pemaju yang menjual hartanah lot Bumiputera kepada bukan Bumiputera tanpa kebenaran perlu dihukum dengan membuat caruman yang sama kepada tabung yang dimaksudkan di atas.

“Selain itu, untuk memastikan golongan miskin Bumiputera terbela, kerajaan juga tidak perlu menetapkan kuota dan diskaun harga Bumiputera untuk hartanah mewah yang melebihi RM1 juta ke atas memandangkan pembeli-pembeli Bumiputera sudah tentu mampu membeli hartanah-hartanah ini atas kemampuan mereka sendiri tanpa bantuan kerajaan.

“Dengan ini, para pemaju tidak perlu menanggung subsidi yang terlalu tinggi dan keuntungan yang diperolehi boleh disalurkan ke dalam tabung yang dimaksudkan tadi untuk membantu lebih ramai orang miskin, khususnya golongan Bumiputera untuk memiliki rumah mereka yang pertama."

雪兰莪州政府应拟定一个透明和有效的土著产业转让系统,好让购买土著产业者能够避免在过于严格的规定所导致的麻烦。

雪兰莪州政府应拟定一个透明和有效的土著产业转让系统,好让购买土著产业者能够避免在过于严格的规定所导致的麻烦。

本人最近接获两宗投诉就是很好的例子。这两宗投诉都是来自由Syarikat Perantara Properties有限公司发展Kelana D’Putera公寓。

第一宗投诉是一名年老的土著屋主想要将他的公寓单位卖给一个求学时期就认识的好朋友却因为这间公寓单位是土著固大单位而无法进行转让手续。

第二宗投诉则是一个非土著屋主遭发展商误导而不小心卖了一间土著固大单位。当他打算卖有关公寓单位给另一个非土著但因为无法进行转让手续而作罢。

在这两宗事件上,除非得到雪州政府的批准,原屋主是不可以售卖他们的土著固大单位。在这漫长的申请转让批准的程序相当耗时而且对买卖双方没有任何好处。

很明显的,现有的产业转让系统出现漏洞,有人为了个人利益将规则操作在自己的手上。雪州政府应设法解决这个问题。

举例,一个土著买主可以只有将房子卖给非土著。条件就是买房必须缴交贡献金给一个专门帮助贫穷的人购买第一间房子的援助基金。

那些将土著固大单位卖给非土著的发展上应该受到对付,他们应该被罚缴交一样的贡献金给上述所提到的援助基金。

此外,为了确保贫穷的土著受到照顾,政府应该取消100万令吉以上豪华房屋的土著固大和土著折扣。这是因为有能力购买此类房屋的人已经不需要政府的帮助。

通过这样的安排,发展上再也不须要承担过高的津贴,额外的利润可以拨入援助基金内。这将能帮助更多的贫穷认识,尤其是第一次购买房屋的土著。

雪兰莪州政府应更快及有效率解决雪兰莪州内坟地缺乏的问题。

雪州是全马人口增长最快的州属同时也是全马坟地需求最高的州属。

这是因为前朝政府的政策没有好好保护坟墓保留地和增加更多是为坟地。

在2012年6月5日与八打灵再也居民会面的时,州务大臣说坟地信托基金的贡献金必须调高好让州政府有足够的钱物色适合做坟墓的土地。

城市与乡区规划部(JPBD)的数据显示,首邦再也市议会、士拉央市议会和八打灵再也市政局坟地缺乏问题最严重。

八打灵再也已经没有都的坟地。因此大臣提出了两个解决方法,那就是设立地方墓园和综合墓园。

因此,州政府应特别关注解决这个问题。其中一个解决八打灵再也坟地缺乏的方法就是鼓励人们进行火葬,这个方法能够减少开销和土地的使用。

八打灵再也华人义山公会已经向学州政府提出申请将他们位于甘榜东姑的焚化场转换成坟墓保留地。为了节约用地,他们也申请在他们的建筑范围的一块小地上建立一座骨灰塔。

令人感到遗憾的是他们的申请被城市与乡区规划部拒绝,他们的理由是当地已经有了焚化场。

在雪州尤其是八打灵再也正处于坟地严重缺乏的情况下,城市与乡区规划部的拒绝理由是很不合理的。

与此同时,乌鲁音南马华人义山公会曾经申请要求一块新的坟地。但他们的申请已经过了很久至今都没有任何消息导致有些往生者被逼葬在私人地里。

因此,雪兰莪州应该拟定长远的计划以解决坟地缺乏的问题及确保八打灵再也和乌鲁音南马人民面对的问题能够得以解决。

雪兰莪州政府须确保筛选维修廉价组屋工程承包商的过程能够很好的运作

我以议会常规第16(2)于2012年7月9日在雪州州议会发表休会演词,以下是演词内容:

雪兰莪州政府须确保筛选维修廉价组屋工程承包商的过程能够很好的运作。

雪州政府自2010年起推出“快乐计划”至今已经拨款970万令吉维修雪州里廉价组屋的屋顶以及电梯。

八打灵再也22区斯里阿曼组屋就是在这计划底下受惠的组屋,该组屋管理层得到拨款用来维修两架坏了的电梯。

但令人感到遗憾的是,在维修这两架电梯的过程中遇到种种问题。其中一个问题就是SIC 有限公司所委任的承包商因为无法按时得到维修费的问题而多次停工。

当我介入解决这事件时,SIC的工作人员告诉我SIC公司没有将付款方式和条件纳入承包合约内。除此之外,我还被告知所有受委的承包商必须完成工程后才能得到维修费。

另一个棘手问题就是承包商拒绝移交控制电梯的电板,他们以此要挟组屋管理层同意委任他们成为该组屋的电梯维修承包商,为期两年。

由于该组屋管理层不满意该承包商表现和服务而拒绝委任该承包商后委任另一个价钱更公道和服务好的承包商,这使问题变得更复杂。

之前的承包商由于不满该管理层的做法而向劳工安全与健康部门(Jabatan Keselamatan dan Kesihatan Pekerja) 投诉该组屋管理层没有依据现有的法令委任承包商。

雪州政府在这事件犯上了两个错误及应该立即采取必要的步骤防止类似的事件一再发生。

第一,避免任何对任何一方无益的争端。州政府应该在承包合约中清除阐明维修费的付款方式,但州政府却没有这样做。

第二,州政府应该时时刻刻和组屋管理层合作和聘请有关方面的专才监察承包商的表现。避免遭不符合资格的承包商误导。

Ucapan penangguhan tentang masalah kekurangan tanah perkuburan di Selangor

Saya selaku ADUN Kampung Tunku dengan ini menyampaikan satu pemberitahu untuk memohon kebenaran ucapan penangguhan mesyuarat akhir persidangan di bawah Peraturan Tetap 16(2) pada 10 Julai 2012, di mana isi kandungan ucapan adalah seperti yang berikut:
“Kerajaan Selangor perlu menyelesaikan dengan cepat dan efektif masalah kekurangan tanah kubur di Selangor.

"Negeri Selangor merupakan negeri yang mengalami kadar penambahan penduduk tertinggi di Malaysia. Susulan dengan itu, keperluan rakyat Selangor terhadap tanah kubur juga antara yang tertinggi di Malaysia.

“Masalah kekurangan tanah kubur di Selangor menjadi semakin tenat disebabkan dasar kerajaan negeri lalu yang tidak tegas dalam melindungi tanah-tanah rizab kubur dan menambah caruman tanah kubur.

“Dalam satu pertemuan dengan penduduk-penduduk Petaling Jaya pada 5 Jun 2012, YAB Menteri Besar telah memberitahu bahawa caruman kepada Tabung Amanah Tanah Kubur perlu dinaikkan supaya kerajaan mempunyai wang yang mencukupi untuk mengambil tanah-tanah yang bersesuaian sebagai tanah kubur.

“Jabatan Perancangan Bandar dan Desa (JPBD) telah mengatakan bahawa keadaan di Majlis Perbandaran Subang Jaya (MPSJ), Majlis Perbandaran Ampang Jaya (MPAJ), Majlis Perbandaran Selayang (MPS) dan Majlis Bandaraya Petaling Jaya (MBPJ) adalah antara yang paling kritikal.

Kawasan Petaling Jaya sudah tiada lagi tanah kubur yang mencukupi dan beliau juga membangkitkan dua cara penyelesaian iaitu tapak kubur setempat dan tapak kubur bersepadu untuk menyelesaikan masalah ini.

“Justeru itu, kerajaan perlu memberi perhatian khas kepada masalah ini. Salah satu cara penyelesaian terhadap masalah kekurangan tanah kubur di Petaling Jaya ialah dengan menggalakkan lebih ramai orang menggunakan cara pembakaran mayat (krematorium) kerana ini sangat menjimatkan kos dan tanah.

“Persatuan Perkuburan Cina Petaling Jaya (PJCCA) telah mengemukakan permohonan kepada kerajaan negeri untuk mewartakan krematorium mereka di Kampung Tunku sebagai rizah tanah kubur. Mereka juga memohon sebidang tanah kecil di luar bangunan mereka untuk didirikan menara habuk mayat (ash tower) untuk menjimatkan tanah.

“Malangnya, permohonan mereka telah ditolak oleh JPBD atas alasan bahawa tanah mereka bukan tanah rizab kerajaan. Tambahan lagi, JPBD juga mengatakan bahawa sudah terdapat tanah krematorium di kawasan yang sama.

“Apabila Selangor amnya dam Petaling Jaya khasnya menghadapi kesuntukan tanah kubur, alasan-alasan JPBD ini memang tidak munasabah.

“Pada masa yang sama, Persatuan Perkuburan Cina Ulu Yam Lama telah menulis untuk memohon sebidang tanah kubur yang baru. Permohonan ini sudah mengambil masa yang lama sehingga terdapat mayat yang terpaksa dikebumi atas tanah persendirian!

“Justeru itu, sementara kerajaan Selangor membuat rancangan buat jangka panjang untuk menyelesaikan masalah ini, kerajaan juga perlu memastikan bahawa masalah-masalah yang dihadapi oleh mesyarakat di Petaling Jaya dan Ulu Yam Lama ini diselesaikan.”

No plans to repossess land

THE state government has no plans to repossess leasehold land where the tenure is to expire over the next few years.

Mentri Besar Tan Sri Khalid Ibrahim said so long as those owning leasehold properties pay a premium of RM1,000, they need not worry about their properties.

“Some of those who own properties in Selangor where the lease is to expire in 20 years time are afraid that they would lose ownership of their homes.

“They need not worry as the owners can extend their lease at the Land Office,” Khalid said at the state assembly sitting yesterday.

The Mentri Besar was responding to a question by Lau Weng San (PR-Kampung Tunku) who said some leasehold property owners in Petaling Jaya were afraid that a caveat might be placed on their properties once the lease tenure expired and the state might repossess their land.

“The public need not worry because houseowners could transfer the land to the next of kin by just paying the premium of RM1,000. However, if the lot, land or house is sold to another person, the premium will be calculated on the market value at that time,” he said.

He pointed out that land in Selangor is expensive and the premium is calculated based on the current price value.

“However, the state does not charge a high premium for leasehold properties owners,” said Khalid, when answering a question by Yap Lum Chin (PR-Balakong) on how many leasehold owners in Selangor paid the RM1,000 premium to extend their lease.

To date, there are 356 applications in eight districts amounting RM356,000 that have been approved since June 2011.

The breakdown from the districts are as follows — Hulu Langat (136), Kuala Selangor (89), Petaling (65), Gombak (48), Klang (6), Hulu Selangor (5), Kuala Langat (4) and Sepang (3).

Khalid added he would meet residents as well as district and assistant district officers in Petaling Jaya on premium to be charged for cemeteries in the district soon.

Lawmakers push for true separation of power

SHAH ALAM: Selangor lawmakers are calling on the state to table a bill to set up an independent service commission for the House in a push for greater democracy.

“In order to become a first-class state assembly, we need to have a service commission under the Speaker that’s independent of the Executive and free from political influence,” said Lau Weng San (Kampung Tunku-DAP).

He said only a truly autonomous legislature can monitor and scrutinise the state administration effectively as practised in advanced democracies like the United Kingdom.

Currently, the state assembly’s administration and budget are controlled by the executive council. Lawmakers have little say.

“The House cannot be considered independent until it has its own service team that is free from the public service,” said Lau, who had returned from a parliamentary seminar in London two weeks ago.

He noted that the Parliament had its own service commission under the Parliamentary Service Act 1963 until the act was repealed in 1992.

Lee Kim Sin (Kajang-PKR) also called on the executive council to table the bill at the next state assembly sitting since the draft is ready.

“When I was attending the London seminar, I was ashamed to tell (lawmakers from other countries) that Selangor has yet to have its own service commission,” said Lee.

Speaker Datuk Teng Chang Khim had told Selangor Times on March 12 that the draft for the Selangor Legislative Assembly Service Commission Enactment (SELESA) was ready.

Teng said the House would have full control of its own budget and staff with the establishment of an independent service commission.

He said the service commission should be chaired by the Speaker, with representatives from the Backbenchers’ Club, opposition and the executive.

However, he said the executive council has yet to approve the draft bill.

Clogged drains raising a stink in SS3

PETALING JAYA: Summonses and warnings have failed to deter restaurants in SS3 from clogging neighbourhood drains with waste and a state lawmaker is calling on the council to take firmer action.

“They have been slapped with summonses and notices to stop dumping food directly into the drains. They’ve paid the fines but still carry on,” said Kampung Tunku assemblyperson Lau Weng San.

“They are responsible for the situation and have to stop dumping food waste into the drains.”

Lau, who visited the site at SS3/31 on Wednesday, said he would be raising the issue with the Petaling Jaya City Council (MBPJ).

He pointed out that the actions of the restaurants is raising the ire of other business owners as well as ratepayers in the area.

There are four restaurants that operate from the shoplots which have been identified as the culprits.

Lau added that he has been receiving complaints of stench due to the stagnant water at the drains, which measure some 800 m from end to end.

On another matter, Lau said waste collection and cleaning contractors serving the SS3 area still had a lot to do.

“The (performance) of contractors is not up to par yet. They are still missing their schedules once in a while,” he said

He called on ratepayers to call the city council’s Public Complaints Hotline number to lodge their grouses on domestic waste collection.

On March 1, a new batch of 32 solid waste contractors started their rounds in MBPJ areas.

More funding for new villages

SHAH ALAM: Development allocations for Selangor new villages have been increased from RM200,000 before 2008 to RM5.4 million in 2009, to help with infrastructure upgrades.

“In the past, each village was only allocated RM2,500 annually but this amount isn’t enough for development,” said state executive councillor Ean Yong Hian Wah (Seri Kembangan-DAP).

Ean Yong said said this in response to a question from Lau Weng San (Kampung Tunku-DAP).

In 2011, RM5 million was allocated for development projects and programmes.

Allocations will be further increased this year as an additional RM1 million will be allocated from the Selangorku grant, bringing it up to RM6 million.

Abolish Batu Tiga and Sg Rasau toll, gov’t told

Mar 28: The Selangor state assembly today demanded the Federal government to abolish two tolls along the busy Federal Highway, namely Sg Rasau and Batu Tiga, following the government’s decision to scrap the Cheras-Kajang highway's toll charges earlier this month.

The motion was tabled by Kampung Tunku state assemblyman Lau Weng San and supported by Selangor speaker Teng Chang Khim.

Lau (pic) said the Federal Highway has been the main channel to serve residents of Petaling Jaya, Subang Jaya, Shah Alam and Klang. He noted that it was built in 1974 to make Port Klang a main hub after Singapore's expulsion from Malaysia in 1965.

However, since 1995, Lau said PLUS was tasked by the Federal government to collect toll charges of RM1.10 for cars passing the Batu Tiga toll plaza and RM1.00 for Sg Rasau since 1995.

“So the daily journey will be RM4.20 every day for residents who use the road, especially those in Klang Valley. The worst part is that despite paying toll, they still have to endure massive traffic jams,” he said.

Lau’s motion also got support from Kota Alam Shah state assemblyman M Manoharan, saying the move would help the urban poor.

Tolls abolished, concessionaire profits

Meanwhile, Works minister Shaziman Mansor revealed that the Cheras-Kajang toll abolishment cost the government RM120.55 million as compensation, and resulted in concessionaire Grand Saga Sdn Bhd extending their toll collection by another 15 years to 2045.

In response, Serdang member of parliament Teo Nie Ching said there was no mention of such a deal.

"When prime minister Najib Razak made the announcement on March 1, he was fooling the public. He did not mention about the new agreement," she said.

Menggesa Kerajaan Persekutuan Menghapuskan Kutipan Tol Lebuhraya Persekutuan II, iaitu di Sungai Rasau dan Batu Tiga

Ucapan ADUN DAP bagi kawasan Kampung Tunku Lau Weng San semasa membentang Usul No. 9 Tahun 2012 pada 27 Mac 2012 di Shah Alam:

Kampung Tunku dengan ini mencadang supaya usul yang berbunyi seperti di bawah dapat diluluskan dalam Dewan Yang Mulia ini:
“Bahawa Dewan yang mulia ini menggesa Kerajaan Persekutuan mengambil langkah-langkah sewajarnya untuk menghapuskan kutipan tol Lebuhraya Persekutuan II, iaitu di Sungai Rasau dan Batu Tiga.”
Setelah kerajaan persekutuan membuat pengumuman untuk memansuhkan kutipan tol Lebuhraya Cheras-Kajang di plaza tol batu 9 (iaitu dari Kajang ke Cheras) dan batu 11 (dari Cheras ke Kajang), kini sudah sampai masanya untuk kerajaan menghapuskan kutipan tol untuk Lebuhraya Pesekutuan II di Plaza Tol Batu Tiga dan Sungai Rasau.

Sejarah Lebuhraya Persekutuan ini bermula sejak pemisahan Singapura dari Malaysia, yang menyebabkan Kerajaan Persekutuan berusaha membangunkan Pelabuhan Klang sebagai pelabuhan utama negara bagi menggantikan Pelabuhan Singapura.

Jalan Kuala Lumpur- Klang yang sedia ada perlu dinaik taraf menjadi sebuah lebuhraya ekspres. Dengan pinjaman daripada Bank Dunia, kerja-kerja naik taraf telah bermula pada tahun 1974 sehingga tahun 1977. Lebuhraya Persekutuan pada asalnya adalah lebuh raya empat lorong kecuali di bahagian Petaling Jaya di mana lebuh raya ini menjadi enam lorong. Sejak itu, pelbagai aktiviti pembangunan telah bertumbuh pesat di kawasan-kawasan sekitar Lebuhraya Persekutuan ini pada tahun 1970-an dan 80-an.

Pada tahun 1992 Plus Expressway Berhad (PLUS) sebagai pemegang konsesi Lebuhraya Utara Selatan, telah dipilih oleh kerajaan untuk menaiktaraf keseluruhan lebuhraya ini kepada enam lorong. Hakikatnya, PLUS diberi hak konsesi untuk mengutip tol di Plaza Tol Batu Tiga (RM1.10 untuk kereta) dan Plaza Tol Sungai Rasau (RM1 untuk kereta).

Sejak itu, penduduk-penduduk Lembah Klang, khususnya mereka yang sentiasa berulang-alik antara Kuala Lumpur, Petaling Jaya, Subang Jaya, Shah Alam dan Klang terpaksa membayar tol semasa mengguna Lebuhraya Persekutuan II setiap hari.

Lebuhraya Persekutuan yang menjadi lebuhraya utama di Lembah Klang telah mengalami peningkatan kadar trafik yang begitu pesat sehingga kapasiti lebuhraya tersebut mencapai kemuncaknya pada pertengahan 1990-an. Kesesakan ini bertambah perit setiap hari pada peak hour. Dijangkakan Lebuhraya Persekutuan menampung kira-kira 30,000 kenderaan setiap hari.

Kesesakan lalulintas sepanjang lebuhraya ini diperitkan lagi dengan kutipan tol di Batu Tiga dan Sungai Rasau. Pengguna-pengguna lebuhraya rata-ratanya tidak berpuas hati dengan kesesakan lalulintas sepanjang lebuhraya ini walaupun mereka terpaksa membayar tol setiap kali mereka berulang-alik di sekitar Subang Jaya, Shah Alam atau Klang.

Pakatan Rakyat dalam Buku Jingga telah menyatakan dengan jelas bahawa kutipan tol untuk semua lebuhraya berbayar di Malaysia boleh dihapuskan. Ini berdasarkan perjanjian-perjanjian konsesi yang ditandatangani oleh kerajaan dengan syarikat-syarikat konsesi yang memperuntukkan satu klausa yang berbunyi “expropriation clause” yang membenarkan kerajaan persekutuan untuk membelli balik lebuhraya itu atas kepentingan nasional.

Di bawah klausa ini, kerajaan persekutuan dibenarkan untuk menamatkan dan membeli balik lebuhraya-lebuhraya ini dengan membayar balik kos pembinaan lebuhraya dicampur dengan apa-apa bentuk faedah yang perlu dibayar ditolak daripada apa-apa bentuk geran atau pinjaman kerajaan.

Justeru itu, tuduhan bahawa pembelian ballik semua lebuhraya bertol di Malaysia adalah tidak praktikal ialah tuduhan liar tanpa mengikut fakta. Lebih-lebih lagi, kerajaan persekutuan telah mula mengambil langkah bagi memansuhkan kutipan tol untuk Lebuhraya Cheras-Kajang dan membekukan kenaikan tol untuk beberapa lebuhraya sebelum ini.

Jikalau kesemua ini boleh dilakukan dan seruan ini disokong oleh parti pembangkang seperti UMNO Bahagian Shah Alam, maka saya tidak menampak sebarang sebab kerajaan persekutuan untuk tidak memansuhkan kutipan tol di Lebuhraya Persekutuan II. Hakikatnya, ini akan mendatangkan lebih banyak kebaikan daripada keburukan kepada rakyat dan kerajaan.

Oleh itu, Kampung Tunku mohon mencadang agar Kerajaan Persekutuan mengambil langkah-langkah sewajarnya untuk memansuhkan kutipan tol Lebuhraya Persekutuan II, iaitu di Sungai Rasau dan Batu Tiga.

Selangor Kata “Tidak” Kepada Kilang-Kilang Radioaktif Di Selangor

“Bahawa Dewan yang mulia ini menetap agar kerajaan Selangor menolak sebarang permohonan pembinaan kilang-kilang yang terlibat dalam pemprosesan bahan-bahan radioaktif di Selangor untuk memelihara hak dan kepentingan rakyat Selangor serta melindungi alam sekitar di negeri Selangor.”
Kampung Tunku membawa usul ini atas kesedaran bahawa rakyat Selangor prihatin dengan perlindungan alam sekitar dan mereka menolak kemasukan apa-apa kilang yang terlibat dalam pemprosesan bahan-bahan radioaktif di Selangor, baik kilang pemprosesan nadir bumi ataupun stesyen janakuasa elektrik yang menggunakan tenaga nuklear.

Industri radioaktif merupakan satu industri berisiko tinggi dan memerlukan bukan sahaja teknologi yang canggih tetapi kepakaran yang tinggi dan pengurusan dan ketat. Industri ini melibatkan kos yang tinggi dan sisa-sisa radioaktifnya perlu diurus dengan berhati-hati berpandukan peraturan yang paling ketat untuk mengelakkan kebocoran radioaktif. Jika tidak kesan-kesan sampingannya adalah berpanjangan dan boleh diwarisi dari generasi ke generasi. Ini kerana kesan-kesan radioaktif akan menyebabkan perubahan gen dalam tubuh manusia dan kesannya adalah berpanjangan.

Pada tahun 2011, rakyat seluruh dunia gempar dengan kemalangan gempa bumi bermagnitud 8.9 pada skala Richter yang menggoncang Jepun. Akibatnya, tsunami berlaku dan kemalangan berlaku di stesyen janakuasa elektrik tenaga nuklear milik Tokyo Electric Power Company (Tepco) di Fukushima, kira-kira 250km dari Tokyo.

Tiga daripada reaktor nuklearnya meletup dan melebur akibat kenaikan suhu reaktor yang gagal dikawal. Kebocoran radiasi berlaku dan 180,000 penduduk masyarakat yang tinggal dalam lingkungan 20km dari kawasan itu juga terpaksa dipindahkan. 160 orang telah disahkan terdedah kepada radiasi. Jumlah kerugian yang ditanggung oleh kerajaan Jepun mencecah US 100 bilion.

Kemalangan ini mendedahkan kegagalan syarikat berkenaan mengikut peraturan-peraturan yang ketat terhadap operasi-operasinya, sekaligus mencetuskan persoalan sama ada penjanaan tenaga elektrik dengan menggunakan tenaga nuklear masih boleh dianggap sebagai selamat dan efisyen. Apatah lagi kemalangan ini berlaku di sebuah Negara yang maju seperti Jepun, yang terkenal seluruh dunia atas disiplin dan ketegasan korporatnya dalam mengikut peraturan dan arahan. Kampung Tunku tidak dapat membayangkannya jika kemalangan ini berlaku di Malaysia.

Sementara itu, kita juga harus mengambil ikhtibar daripada kes kilang Asia Rare Earth (ARE) di Kampung Bukit Merah, Ipoh pada tahun 1984 di mana penduduk-penduduk Kampung Baru Bukit Merah, Ipoh menjadi mangsa radiasi akibat terdedah kepada sisa-sisa radioaktif apabila bekerja di kilang pemprosesan nadir bumi (rare earth) ARE yang terletak tidak jauh daripada kampong mereka.

Masyarakat Malaysia digempurkan sekali lagi apabila sebuah syarikat nadir bumi bernama Lynas bercadang untuk membina kilang sebesar 140 padang bola sepak di Gebeng, Kuantan. Baru-baru satu perhimpunan telah diadakan di Kuantan untuk membantah kilang Lynas ini.

Perhimpunan ini dihadiri oleh 10,000 warga Malaysia dari seluruh pelosok Negara. Ini adalah kerana pencemaran radiasi ini amat berbahaya, ianya tidak berwarna dan berbau tetapi boleh diwarisi turun-temurun dan radiasi boleh disebar ke tempat-tempat yang jauh jika tidak dikawal dengan baik.

Sebelum ini pada Disember 2010, Menteri Teknologi Hijau, Tenaga dan Air, Datuk Seri Peter Chin mengumumkan Malyasia akan membina dua loji tenaga nuklear yang mampu menjana 1,000 megawatts setiap satu. Loji pertama dijadual beroperasi pada 2021 manakala yang kedua setahun kemudian. Kos pembinaan dijangka mencecah RM 22 bilion.

Kerajaan Persekutuan harus membatalkan cadangan untuk membina dua loji tenaga nuklear dan sebaliknya memberi fokus kepada tenaga boleh diperbarui untuk menampung keperluan tenaga Negara. Sudah terbukti dalam kes Fukushima bahawa tenaga nuklear bukan sumber tenaga yang bersih, efisien dan selamat.

Menggesa Kerajaan Persekutuan untuk berunding semula dengan syarikat konsesi Lebuhraya Pantai Barat

Kampung Tunku dengan ini mencadang supaya usul yang berbunyi seperti di bawah dapat diluluskan dalam Dewan Yang Mulia ini:
“Bahawa Dewan yang mulia ini menggesa Kerajaan Persekutuan untuk berunding semula dengan syarikat konsesi Lebuhraya Pantai Barat agar hak dan kepentingan rakyat Selangor dipelihara.”
Baru-baru ini Kumpulan Europlus (KEuro) mengumumkan bahawa kos pembinaan Lebuhraya Pantai Barat meningkat 134% daripada RM3.015 bilion ke RM7.07 bilion sementara tempoh konsesi juga dinaikkan daripada 33 tahun ke 60 tahun.

Sebagai pemegang konsesi lebuhraya ini, Kumpulan Europlus (KEuro) telah melapor kepada Bursa Malaysia pada 25 Mei 2007 bahawa anak syarikat kepada KEuro, iaitu Konsortium LPB Sdn. Bhd. (KLPB) telah menandatangani perjanjian konsesi dengan Kerajaan Persekutuan untuk membina lebuhraya sepanjang 215.8 km dari Taiping ke Lapangan Terbang Antarabangsa Kuala Lumpur melalui Banting dengan kos pembinaan sebanyak RM3.015 bilion.

Walaupun perjanjian ini ditandatangani pada tahun 2007, pembinaan lebuhraya ini ditangguhkan selama lima tahun sehingga sekarang. Beberapa minggu yang lalu KEuro mengumumkan bahawa kos pembinaan telah meningkat ke RM7.07 bilion sementara tempoh konsesi juga telah dilanjutkan daripada 33 tahun ke 60 tahun, sekaligus menjadikan lebuhraya ini dengan tempoh konsesi yang terpanjang di Malaysia.

Apa yang lebih memeranjatkan ialah Kerajaan Persekutuan begitu murah hati dengan meluluskan soft loan sebanyak RM2.24 bilion dengan faedah hanya 4% setahun kepada KEuro. Selain itu, subsidi faedah sehingga ke 3% dberi terhadap pinjaman komersial KEuro untuk tempoh waktu selama 22 tahun. Selain daripada itu, kerajaan persekutuan akan menanggung kos pengambilalihan tanah yang dijangka berjumlah RM980 juta.

Dalam pengumuman terbaru ini, KEuro juga menerangkan bahawa kenaikan kos pembinaan ini adalah disebabkan oleh kepanjangan lebuhraya ini bertambah 100km lagi, yakni dari 216km hingga ke 316km, iaitu pertambahan sebanyak 46%.

Walaupun begitu, kerajaan persekutuan masih belum menjelaskan sebab-sebab kos pembinaan meningkat 134% sedangkan kepanjangan lebuhraya hanya meningkat 43% sahaja. Lebih-lebih lagi, jarak antara Banting dan Taiping tidak akan bertambah 100km dengan tiba-tiba.

Kerajaan persekutuan harus menjelaskan persoalan-persoalan yang dibangkitkan di atas memandangkan kerajaan akan menggunakan wang pembayar cukai untuk membiayai pembinaan lebuhraya ini dan rakyat Selangor yang akan membayar tol nanti apabila lebuhraya ini siap dibina.

Lebih-lebih lagi, kerajaan persekutuan mendukung cita-cita untuk mentransformasi pentadbiran kerajaan melalui beberapa siri pelan transformasi. Perdana Menteri juga melaungkan gagasan 1Malaysia dengan slogan “rakyat didahulu, pencapaian diutamakan”. Jika begitu, maka Perdana Menteri perlu menjelaskan mengapa kos pembinaan lebuhraya ini melonjak naik dengan begitu dahsyat. Adakah rakyat betul-betul didahulukan, ataupun kroni-kroni yang mendapat kebaikan daripada projek ini?

Pertama sekali, rakyat perlu menanggung perbelanjaan yang amat besar untuk lebuhraya ini kerana kerajaan persekutuan menggunakan wang rakyat untuk membiayai pembinaannya. Yang kedua, tempoh konsensinya juga akan dinaikkan ke 60 tahun. Barangkali cucu-cicit kita masih perlu membayar tol semasa mengguna lebuhraya ini 60 tahun kemudian.

Prestasi syarikat konsesi juga dipersoalkan di mana presiden dan ketua pengarah KEuro ialah Tan Sri Chan Ah Chye. Beliau memegang 27.58% saham dalam KEuro dan juga merupakan ahli lembaga pengarah kepada Talam Corporation Bhd, sebuah syarikat hartanah yang berkontroversi dan pernah dibelenggu dengan hutang menggunung tinggi pada masa silam.

KEuro hanya mendapat pendapatan dan untung sebanyak RM15 juta dan RM5 juta dalam sembilan bulan pertama tahun 2011 selepas mengalami kerugian RM24.1 juta ringgit pada tahun 2010 dengan pendapatannya sebanyak RM20.5 juta.

Bagaimana sebuah syarikat yang hanya untung RM5 juta diberi projek sebesar RM7.07 bilion untuk ditangani. Malahan, syarikat konsesi ini langsung tiada pengalaman untuk membina lebuhraya walaupun pemegang sahamnya yang satu lagi, iaitu IJM mempunyai kepakaran dalam bidang ini.

Kesemua ini menunjukkan terdapat sesuatu yang tidak kena dengan konsesi ini kerana ianya amat merugikan rakyat, khususnya rakyat Selangor yang sudah pasti akan dibebankan dengan satu lagi lebuhraya bertol, kali ini di kawasan persisiran pantai.

Saya meminta semua Ahli Dewan yang mulis ini untuk menyokong usul ini. Saya juga meminta semua wakil rakyat Barisan Nasional (BN) khususnya mereka dari kawasan persisiran pantai seperti Sungai Air Tawar, Sabak, Sungai Panjang, Sungai Burung, Permatang, Jeram, Sementa dan Tanjung Sepat untuk berdiri menyokong usul ini dan mendesak Kerajaan Persekutuan untuk berunding semula dengan KEuro.

Perlantikan keahlian dalam Jawatankuasa Pilihan Khas Melalui Pemilihan Secara Undi Rahsia

Ucapan ADUN DAP bagi kawasan Kampung Tunku Lau Weng San semasa membahas Usul No. 2 Tahun 2012 berkaitan dengan keahlian Jawatankuasa Pilihan Khas mengenai Keupayaan, Kebertangungjawaban dan Ketelusan (Selcat) 26 Mac 2012 di Shah Alam:

Kampung Tunku berdiri menyokong usul ini untuk melantik Ahli Yang Berhormat dari Subang Jaya menggantikan mendiang Ahli Yang Berhormat dari Bukit Gasing di dalam Pilihan Khas mengenai Keupayaan, Kebertangungjawaban dan Ketelusan.

Perlantikan ini adalah perlu memandangkan Selcat memerlukan kerjasama erat daripada semua anggotanya untuk menjalankan fungsi yang dipertanggungjawab kepada Selcat oleh Dewan Yang Mulia ini.

Dalam satu seminar yang dianjurkan oleh Commonwealth Parliamentary Association (CPA) mengenai praktis dan prosidur Parlimen yang dihadiri oleh Kampung Tunku dari 4 hingga 9 Mac 2012 yang lalu, Kampung Tunku difahamkan bahawa keanggotaan dalam setiap satu jawatankuasa pilihan di dalam Parlimen UK adalah dipilih oleh ahli-ahli Dewan mengikut nisbah parti kerajaan kepada pembangkang secara undi rahsia.

Fenomena ini amat berbeza dengan fenomena di Malaysia di mana keanggotaannya ditentukan oleh parti-parti politik masing-masing. Kampung Tunku berharap pada masa yang akan datang, keahlian dalam semua jawatankuasa pilihan khas Dewan Negeri Selangor ini dijalankan melalui pemilihan secara undi rahsia.

Kampung Tunku sedih dan kesal kerana baru-baru ini terdapat individu-individu tertentu yang membuat tuduhan liar terhadap Selcat. Ada di kalangan mereka menuduh jawatankuasa ini sebagai mahkamah kangaroo apabila Selcat meminta mana-mana individu yang mempunyai bukti tentang kes-kes pencurian pasir di Selangor untuk tampil member keterangan di hadapan Selcat. Ada di kalangan mereka ini begitu lantang sehingga mereka mencabar kesahihan kedudukan Selcat di mahkamah. Ini sebenarnya bercanggahan dengan Perlembagaan Persekutuan dan Undang-undang Tubuh Kerajaan Negeri Selangor kerana telah dinyatakan dengan jelas bahawa sebarang keputusan dan prosiding Dewan Negeri Selangor tidak boleh dicabar di mahkamah.

Malangnya individu-individu ini tidak berani tampil ke hadapan. Ini menimbulkan satu persoalan yang besar iaitu sama ada individu-individu ini benar-benar mempunyai bukti ini ataupun mereka hanya berminat untuk menggaut keuntungan politik sahaja?

Kampung Tunku faham terdapat individu-individu yang bercita-cita besar untuk menjadi Menteri Besar. Terdapat juga yang ingat dia akan menjadi Exco. Nasihb tidak menyebelahi mereka apabila cita-cita mereka ini tidak kesampaian pada tahun 2008. Apapun sekali, kegagalan individu-individu ini untuk mengemukakan apa-apa bentuk bukti menunjukkan betapa temperangnya hujah-hujah politik mereka.

Malahan Kampung Tunku difahamkan bahawa mereka masih belum membuat laporan dengan polis atau Suruhanjaya Pencegah Rasuah Malaysia (SPRM) bagi membendung gejala ini. Mereka harus sedar bahawa adalah menjadi satu kesalahan bagi mana-mana individu untuk tidak melaporkan satu perbuatan rasuah yang diketahuinya kepada SPRM untuk siasatan lanjutan.

Apapun sekali, harus diingatkan bahawa Selcat memang bukan sebuah mahkamah. Selcat seperti jawatankuasa-jawatankuasa pilihan khas yang lain tidak mempunyai kuasa untuk menghukum mana-mana individu. Selcat ditubuhkan oleh Dewan Negeri Selangor pada tahun 2008 untuk menyiasat sebarang salahlaku pihak kerajaan. Dalam perkataan lain, peranan yang dimainkan oleh Selcat ialah untuk menyemak, mamantau dan mengimbang pihak eksekutif.

Selcat mempunyai kuasa untuk memanggil mana-mana saksi bagi memberi keterangan secara terbuka melalui pendengaran awam bagi mana-mana isu yang berkepentingan awam.

Pemberian keterangan secara terbuka ini dapat membantu dalam mempertingkatkan tahap ketelusan dalam pentadbiran awam kerana saksi-saksi yang dipanggil akan terletak di bawah pemantauan awam (public scrutiny). Konsep jawatankuasa pilihan ini merupakan satu pembaharuan dalam menjalankan fungsi-fungsi parlimen di kebanyakan Negara Komanwel dan ianya dipelopori oleh Parlimen Britain sehingga Perdana Menteri Britain pun boleh dipanggil untuk memberi keterangan di hadapan jawatankuasa pilihan (sila rujuk sini.)

Justeru itu, Kampung Tunku menggesa individu-individu yang tidak bertanggungjawab ini untuk segera menarik balik semua tuduhan yang tidak berasas dan memohon maaf kepada Dewan secara terbuka. Pada masa yang sama, Kampung Tunku juga menasihat mereka menyerah sebarang bukti dalam pegangan mereka kepada Selcat jikalau mereka benar-benar ikhlas.

Kampung Tunku juga mengucapkan Selamat Bertugas kepada Yang Berhormat Subang Jaya. Sememangnya tugas yang ada pada Subang Jaya adalah berat dan Kampung Tunku percaya Subang Jaya dapat menjalankan tugas ini dengan sempurna.

Oleh itu, Kampung Tunku menyokong usul ini. Sekian, terima kasih.

BN harus berfikiran terbuka dan melantik Ketua Pembangkang sebagai pengerusi PAC

Ucapan ADUN DAP bagi kawasan Kampung Tunku Lau Weng San semasa membahas Usul No. 1 Tahun 2012 berkaitan dengan keahlian Jawatankuasa Kira-kira Wang Awam pada 26 Mac 2012 di Shah Alam:

Usul ini akan melantik Ahli Yang Berhormat dari Kajang sebagai Pengerusi Jawatankuasa Kira-kira Wang Awam (PAC), di mana beliau pernah memegang jawatan ini bermula tahun 2008 hingga Julai 2010.

Sementara itu, Ahli Yang Berhormat dari Sungai Burung dikekalkan sebagai Ahli Jawatankuasa Kira-kira Wang Awam, ialah wakil Pembangkang pertama di dalam sejarah Dewan Negeri Selangor yang dilantik sebagai Pengerusi PAC bermula Julai 2010 hingga sekarang.

Sementara itu, Kampung Tunku ingin mengucapkan tahniah kepada Ahli Yang Berhormat dari Sijangkang kerana telah dilantik sebagai Ahli Majlis Mesyuarat Kerajaan Negeri (MMKN) Selangor dan kekosongan beliau diganti oleh Ahli Yang Berhormat dari Meru.

PAC mempunyai sejarah tersendirinya sebagai sebuah jawatankuasa yang ditubuhkan buat kali yang pertama di Parlimen UK pada tahun 1861 atas ilham Menteri Kewangan UK pada masa itu, iaitu William Ewart Gladstone. Tujuan penubuhan PAC pada masa itu bertujuan untuk mempertingkatkan pemantauan dan penyemakan kira-kira wang awam selain daripada sesi persidangan Parlimen kerana Parlimen UK melihatkan ada keperluan untuk mengadakan satu jawatankuasa Parlimen yang diberi tugas khusus untuk memantau dan menyemak cara penggunaan wang kerajaan.

Tugas dan fungsi PAC adalah berkaitan rapat dengan Jabatan Audit Negara. Di UK, hubungan yang rapat ini terlihat apabila Ibu Pejabat Ketua Audit UK berada berdekatan dengan bangunan Parlimen agar pihak Audit dapat memberi khidmat nasihat yang cekap kepada Parlimen, khususnya kepada jawatankuasa-jawatankuasa Parlimen.

PAC di UK juga mempunyai tiga fungsi utama, iaitu sebagai satu satu pihak yang perlu menurunkan tandatangan untuk meluluskan pemindahan wang daripada Kumpulan Wang Yang Disatukan untuk kegunaan kerajaan. Tanpa tandatangan pegawai Ketua Audit Negara, wang ini tidak akan dipindahkan. Ini barangkali tidak berlaku di Malaysia.

Kedua, Ketua Audit bertugas untuk menyemak dan memantau semua akaun jabatan kerajaan, badan-badan berkanun dan anak-anak syarikat kerajaan dan ketiga, menyemak kecekapan penggunaan wang kerajaan. Walaupun Ketua Audit Negara di UK sentiasa bekerjasama dengan PAC, tetapi mereka tidak mengambil arahan daripada PAC dan House of Commons.

Dalam konteks Dewan Negeri Selangor, peranan Jawatankuasa Kira-kira Wang Awam atau Kerajaan telahpun diperuntukkan di bawah Peraturan-peraturan Tetap 68 di mana jawatankuasa ini ditubuhkan untuk memeriksa:
(a) kira-kira Kerajaan Negeri Selangor dan peruntukkan wang yang dibenarkan oleh Dewan kerana menepati perbelanjaan Negeri;
(b) apa-apa kira-kira badan-badan pentadbiran raya dan pertubuhan-pertubuhan lain yang menguruskan wang negeri yang dibentangkan dalam Dewan;
(c) penyata-penyata Juru Audit Negara dibentangkan dalam Dewan menurut Perkara 107 (2) dalam Perlembagaan Persekutuan;
(d) apa-apa perkara lain yang difikirkan oleh Jawatankuasa itu patut diperiksa, atau apa-apa perkara yang diserahkan oleh Dewan kepada Jawatankuasa itu.

Dari sini kita dapat melihat bahawa PAC mempunyai peranan dan tanggungjawab yang amat berat untuk memastikan setiap perbelanjaan kerajaan dibelanjakan dengan berhemah, bertanggungjawab dan menepati matlamat asal yang ditetapkan. Malangnya selama 50 tahun Barisan Nasional menjadi kerajaan, Dewan Negeri Selangor dilihat sebagai rubber-stamp untuk Eksekutif dan peranan yang sepatutnya dimainkan oleh Dewan dan Jawatankuasa PAC telah diabaikan.

Apabila Pakatan Rakyat mula mengambil kerajaan negeri Selangor, pembangkang tidak dilantik menjadi Pengerusi PAC kerana jika ini berlaku akan berlakunya percanggahan kepentingan atau conflict of interest, di mana Pengerusi PAC dari Barisan Nasional mungkin tidak akan menyiasat perkara-perkara melibatkan kerajaan negeri yang lalu. Justeru itu, Pengerusi PAC yang dilantik pada masa itu ialah ADN Kajang. Apabila kerajan PR masuk ke tahun pentadbiran yang kedua iaitu tahun 2009, barulah Dewan memutuskan untuk melantik wakil daripada pembangkang untuk menjadi Pengerusi PAC.

Kampung Tunku masih ingat terdapat beberapa orang Ahli Yang Berhormat dari BN yang mengatakan bahawa perlantikan wakil pembangkang sebagai Pengerusi PAC tiada gunanya kerana beliau akan menjadi seorang pengerusi yang tempang kerana majoriti anggota-anggota dalam PAC masih daripada PR.

Kenyataan ini jelas menunjukkan kebuntuan fikiran Ahli-ahli Yang Berhormat berkenaan kerana setiap anggota dalam mana-mana jawatankuasa Dewan harus berfungsi dengan bebas dan tidak diganggu oleh agenda politik kepartian. Selain itu, keanggotaan dalam PAC perlu mencerminkan nisbah kerajaan:pembangkang dalam Dewan.

Biarpun begitu, pengerusi PAC bukan satu jawatan boneka. Beliau mempunyai kuasanya sendiri untuk memulakan apa-apa siasatan terhadap mana-mana badan kerajaan. Pengerusi PAC, seperti pengerusi jawatankuasa-jawatankuasa Dewan yang lain, perlu merancang lawatan, memanggil pendengaran saksi, menentukan soala-soalan terhadap saksi, memberi cadangan-cadangan penyelesaian dan menyediakan penyata untuk dibentangkan ke dalam Dewan Yang Mulia ini.

Kampung Tunku tidak mengetahui sebab Yang Berhormat Sungai Burung meletakkan jawatan sebagai Pengerusi PAC sedangkan ini merupakan tradisi di semua Parlimen Negara-negara Komanwel. Walaupun begitu, jika keputusan ini dilakukan semata-mata budaya politik sempit BN, Kampung Tunku berasa kecewa kerana minda BN masih belum berkembang dan terbuka untuk menerima idea-idea baru seperti perlantikan Ketua Pembangkang menjadi Pengerusi PAC.

Kalau Barisan Nasional (BN) mempunyai cita-cita besar untuk menawan semula Selangor daripada Pakatan Rakyat (PR) dan sekiranya BN betul-betul hendak “menyelamatkan” Selangor daripada “kezaliman” PR, maka wakil daripada BN (Pembangkang) harus memegang jawatan ini dan menjalankan tugas ini dengan tulus ikhlas untuk memantau dan menyemak pengurusan kewangan kerajaan negeri.

Dengan melepaskan jawatan ini kepada PR, adakah ini bermakna laungan BN untuk menawan Selangor daripada PR, hanya hangat-hangat tahi ayam sahaja?

Apapun sekali, Ahli Yang Berhormat Sungai Burung sudah meletakkan jawatannya sebagai Pengerusi PAC dan Dewan perlu memilih seorang pengerusi yang baru. Sementara itu, dengan perlantikan Ahli Yang Berhormat Sijangkang sebagai anggota MMKN, kekosongan yang ditinggalkan beliau juga perlu diisi dengan segera supaya tidak mengganggu perjalanan tugas PAC.

Kampung Tunku juga mengucapkan Selamat Bertugas kepada Yang Berhormat Meru. Sememangnya tugas yang ada pada Meru adalah berat dan Kampung Tunku percaya Meru dapat menjalankan tugas ini dengan sempurna.

Towards a first class state assembly

Kampung Tunku would like to take part in the debate on Royal Address Motion upholding Love of His Royal Highness The Sultan of Selangor and I would like to honor the highest to the Sultan of Selangor for His Majesty said has touched many areas of the Selangor State Government administration should be given a serious attention by the Executive.

Out of 20 pages of Selangor Sultan speech yesterday, at least 20 percent of the content touched on the role of the State Assembly as the best medium to solve the matters and issues affecting the people of Selangor.

Even the Majesty also remind all the Honourable Members to discuss the issues involving residents of Selangor with intellectual and not emotionally. The Tuanku advice is very sound and timely and it must be accompanied by empowerment of the Selangor State Assembly as a credible legislative institution.

I together with Kajang State Assemblyman are elected to represent the Selangor State Assembly to attend Westminster Seminar -61 relating to Practice and Procedure of Parliament from 5th to 9th March 2012. We both have been exposed to the various reforms, and it is being held in Westminster.

Among the issues discussed on how the UK parliament works, the existing UK legislative process and reforms that were implemented, the role played by Members Assembly, private bills of Members, Leader of Opposition, Leader of the House, WIP part and working relationship between them, free from any influenced from the Executive, Select Committee, administration and financial management of Assembly, the responsibility of prime minister via Prime minister Question Time, the role of speaker, the role played by Rights and Privileges Committee and its mode of operation. Other than that, UK Parliament has also set up E-Petition at its official website to enable people to raise the issues that they would like to convey to the Members of Parliament.

The discussion on these matters has opened up our minds about the vital role of the House. It also reminds us of the importance of the House to be one which is modern, professional, systematic, efficient and free because the existence of these qualities would enable the House to play its role effectively and become the best medium for its members to exercise their functions as elected representatives.

A requirement that has to be followed before Selangor State Assembly could completely change into first class House is the existence of a system service under the Speaker of Assembly which is independent from Executives and free from any political influences

During the seminar, I was amazed by the statement given by Mr. Robert Rogers, Secretary for House of Commons of UK Parliament, that he was proud the whole Parliament services does not fall under the Executive body and they are not part of the civil services

This statement reminds me of an important facts where the true liberty of State Assembly is not considered to have been accomplished unless it has a service team which is free from any influences by public services. This is because each function that has to be performed, in the context of UK Parliament, it has to be carried out by a professional and independent team under the direction of the Speaker to take the view and needs of each member of State Assembly. UK Parliament free from any form of influences which allows it to monitor and review the overall administration without any restrictions and excessive bureaucracy.

Such a free Assembly should be supported by the independent service and this is the essence of RUU Selangor State Assembly or short form “Selesa”. To welcome the advice of the Majesty, the Selangor State Assembly should be the best medium to resolve the issues and the people, therefore Kampung Tunku recommend the Enactment Selesa should be created in the near future.

Last year, the Deputy Speaker of Parliament, The Honourable Dato’ Wan Junaidi also supports to restore Parliamentary Service Act 1963 which was repealed in 1992. The Act provides a services system which is free from any influences from Executive body, the Public Service department has to determine the rights and powers of the Assembly in the course of daily work and financial management of the House.

Thus, for those who remember that this law as something new, then the Parliamentary Services Act 1963 showed the contrary. If the Selangor State Assembly’s proposal to enact Selesa Enactment was supported by Parliament Malaysia, therefore Kampung Tunku did not see any reason not to enact Selesa.

Economic Development and efficiency of local authorities and government departments

His Majesty’s speech also touched on the issue of economic development whereby the GDP for the Selangor State in the year of 2011 was 5.9% and this figure is expected to drop to 5.3%, being in line with the economic circumstances of the world and Malaysia, which are moderate

The Selangor State continues to contribute towards the development of Malaysia’s economy, in which the Selangor State contributed 22% with a total investment record of RM8.74 billion in 2011, together with 263 projects being implemented and as much as 263 job opportunities being created in the process.

These figures are indeed a major leap as compared with the year of 2010 in which the total investment in the Selangor State was only recorded at RM6.53 billion. That notwithstanding, there are still many shortcomings which the government agencies, in particular the Land and District Office and Local Councils, need to work on.

His Majesty the Sultan of the Selangor also urged that we should practice transparency and also to simplify the procedure as well as to speed up the process involved.

Kampung Tunku agrees absolutely with this advice and all parties involved should work together in reducing red tape and bureaucracy so as to attract more investors to invest in the State of Selangor.

For the aforementioned purposes, Kampung Tunku would like to discuss a little about the performance of OSC at LOCAL COUNCILSs of Klang Valley. Kampung Tunku is of the opinion that there are still a few problems which need to be overcome to improve the performance of OSC. This problem is none other than the problem with OSC’s effectiveness in assisting the development of the economy.

Kampung Tunku realised that applicants have filed complaints saying that their applications have been rejected because they have failed to adhere to the conditions required by local councils. This problem surfaced because it is always the case that the documents and plans submitted do not meet the local councils’ requirements. Surprisingly, is the fact that such technical requirements are not clearly stated in local councils’ checklist.

This is because such technical requirements consist of fine technical aspects, leading to the eventual rejection of those applications when in fact such technical requirements could have been made clear to the relevant negotiators or applicants from the very beginning.

For example, Kampung Tunku discovered that one application for Planning Approval handled by MPSJ was rejected by its Building Control Department on the following grounds:
1. To provide for tap/water pipe for every toilet.
2. To submit the plan for the project notice board complete with motto, approved file number and the Majlis’ motto.
3. To check the size of the plan used. Not suitable.
4. Please use water color to make the plan tidier.
5. The design for the Surau is inappropriate. Please discuss.

As the saying goes “The evils lie in the details”; as can be seen, the grounds relied upon to reject the application were ambiguous and subjective, so much so that even things such as the materials used to produce the plan are also under scrutiny. Apart from that, requirements such as the design of the surau is very difficult to define and overtly subjective.

Besides the departments within the local councils, the performance and response of other departments such as JPS and the Fire Department et cetera should also be improved although chances are these departments are not under the jurisdiction of the State Government.

Although the EXCO member has stated previously that those approvals from external departments would be exempted if the representatives of these departments have been absent from 3 OSC meetings consecutively, there is a totally different story at the grassroots level. I am worried that this direction has yet to be communicated to the officers of local councils and thus they are still asking the applicants to obtain approvals from those external departments first before they would give their full approval for their projects.

This also happened because the officers of local councils still insist on strict compliance with all the technical requirements to prevent any unwanted event from happening.

This problem is also aggravated due to the role of OSC, which has yet to function as a truly "One-Stop Centre”. This is because applicants still have to engage runners to submit documents to other departments even though the initial concept of the OSC is to process all the documents at one fixed place and time to save time and to reduce red tape.

Foreign Investment needs to focus more on green & advanced technology which can generate higher income.

Kampung Tunku also interested with Selangor government's explanation regarding Selangor Automobile Belt. Indeed, automobile industry is an industry which can elevate Selangor position as a more advanced state, equal with other advanced countries.

Government must pay serious attention and encourage high return investment. For example, green industries such as solar powered industry, recycling industry, water and air purification, water wastage treatment, biodiesel industry, environment recovery industry, solid waste management, energy storage, alternative energy sources such as solar energy and so on.

Recently, biodiesel was launched in Selangor and the Klang Valley. This product has become an alternative fuel to conventional fossil fuels. Therefore, the state government of Selangor should attract more investment to carry out research on second-generation biodiesel production which does not need to rely on palm oil.

An important condition for high-quality investors to invest in the Selangor is the existence of high quality talents (talent pools) available to provide support services to these industries such as engineering specialists, logistics, service and research

Without these talents and manpower, it is very difficult for Selangor and Malaysia to attract high quality investment because industries with high added value, which listed above, are dependent on highly skilled experts.

Kampung Tunku was very happy with media reports recently that Phison of Taiwan, a company founded by a Selangor man from Sekinchan, Mr Pua Khien Seng in 2000, will invest RM3 million in Malaysia. What is not so encouraging is this company's investment destination is in Penang and the northern peninsula and not in Selangor, even though the founder is from Selangor.

This news proves a fact that Selangor also must compete with other states in attracting high quality investment to the country. Selangor Government can not underestimate the other competitors and have to check what the weaknesses which are still there that high tech investors are willing to invest millions in other states.

If the above shortcomings can be overcomed, then Kampung Tunku is very confident that there is chance to attract high quality investors to invest in Selangor. In fact, Selangor can multiply this figure.

Reshuffle of State government revenue system to reduce the administration cost.

In the previous Assembly meeting, Kampung Tunku had raised the issue of profit margin which previously raised by YAB Menteri Besar, where the YAB Menteri Besar had stated that the margin need to be lowered from 30% to around 7% in order to reduce the State government administration cost.

Kampung Tunku would like to ask the State government what are the steps taken to achieve this target?

Does the Selangor State government set a list of price gap for infrastructure project and acquisition to avoid excessive price was paid to the supplier or contractor?

Does the government also reshuffle the "cut off" system which was first used by the government departments in year 2004, considering the fact that practice of "cut off" system does have the exceptions, namely when the number of tenders received and can be counted after the "freak" price issued less than ten.

It must be noted that the tenderers who offer a lower price than the "cut off" price can also be considered if they have an excellent track record, which has the experience to perform the same work ahead of the schedule. Acquiring a certain factors that can be guaranteed them to do the work with lower price and quality work and time is at the satisfactory level.

Grant "Selangorku" – set up the school bus subsidy for poor students in traditional village

Selangor State government has approved a grant "Selangorku" of RM 300 million which consist of 17 sectors that required serious attention from the government.

The Grant which is so large in size will be administrated by the Menteri Besar Corporation or Mentri Besar Incorporated (MBI) proved the solid financial strength of subsidiaries under the Selangor State government. One good thing is that the allocation of this RM 300 million will be revealed to the public without the need of going through the normal bureaucracy process

Kampung Tunku welcomed the Selangor State government policy and Kampung Tunku urged the government to give special attention to the development of rural area. Through the grant of "Selangorku", about RM 10 million will be allocated for urban life expectancy programme and targeted to rural area residents.

Not long ago, a poor Selangor people who lived in rural area facing the transportation problem when the public bus company CityLiner ceased the bus services in few village area.

One of the affected area is Teluk Gong whereby the children to the families of poor fisherman and farmer are unable to attend school due to the cessation of CityLiner bus services. I understand that the students need bus services to go and back from their school, where most of them were located at Pandamaran Jaya area.

By looking at the problem faced by the people at Teluk Gong area and at the same time, Selangor State government also launched the grant of "Selangorku" which allocated RM 10 million to improve the living standard of rural area folks, hence Kampung Tunku suggest to the government to implement a school bus scheme similar to subsidized bus scheme for plantation workers’ children.

The important thing is, the welfare of poor students from rural area should not neglected just because the federal government’s failure to manage properly the public transport system. It is necessary to implement this kind of school bus scheme at different rural areas scattered around Selangor because Kampung Tunku believed the same problem also occurred in other rural areas.

Environmental Protection – Defending Bukit Gasing from being intruded

His Majesty’s Speech also touched on the issue of environmental protection. Kampung Tunku would like to raise a significant environmental issue, the issue of hillside development which is under the administration of City Hall (DBKL)

The residents of Bukit Gasing, Petaling Jaya has organized a protest against the decision not long ago to City Hall to approve a development project in Bukit Gasing which is located in the Federal Territory of Kuala Lumpur.

Residents protested although some part of Bukit Gasing which is located next to Selangor state has been gazetted as green areas, the next development will also affect the ecology and stability of the soil around the hill.

Regards to ADUN Bukit Gasing, YB Edward Lee is the man who helped a lot the residents of Bukit Gasing to reject the development project approved by City Hall DBKL, but until now it is still a dead end.

What the people of Bukit Gasing regret is the attitude of KL Mayor, who is under the control of BN government, who does not want to compromise and continue to grant approvals to the project regardless of hugh objections from the residents. That is the attitude of so-called which promise to advance the people but in fact they are more advance their own interests.

As citizen of Petaling Jaya, Kampung Tunku request intervention from the Selangor government to assist Bukit Gasing people to solve the problem.

Crisis of water industry restructuring in Selangor

In the last assembly, many parties have the speculation that Selangor will face water crisis in 2014. This statement is also supported by Ministry of Energy, Water and Green Technology last year. Then during the last session, this statement was reported with the argument that all water treatment in Selangor were operating at the maximum level to produce 4,326 million litre of water a day to accommodate 4,197 million litre of water a day, where the margin of the water storage of 129 million litre of water a day is told not sufficient to face any water crisis.

It was a last year story. What else happened recently? Lately, Syabas again repeat its obsolete story that in this year 2012, Selangor would face water crisis. After that, few weeks ago, Syabas announced that the water supply will be cut off for 36 hours to carry out maintainance works on water treatment.

Eventually, Syabas indirectly admitted that the cause of low water margin is due to Syabas water treatment capacity is not properly maintained.

Even so, during the period of disconnection of water supply, many places in Klang Valley still have the sufficient water supply. Does it mean the water crisis touted by certain parties merely a fiction to frighten Selangor people?

However, Kampung Tunku feel relieved because Selangor government under Chief Minister met with the water management experts and legal experts from United Kingdoms to find a way out to solve the water crisis in Selangor.

For the Selangor people’s interest, I would like to request Chief Minister to explain to this Honourable House the findings of experts from UK so that the issues can be solved quickly.

Government Land Ownership Scheme for Private Residential Buildings with premium RM1000

Selangor government made a history by offering Government Land Ownership scheme for private Residential buildings to the people only RM1000 premium. This is one of the administrative reforms that we feel proud of.

This policy is a good policy and Kampung Tunku would like to ask government to see whether this policy may be extended to owners for industrial and commercial land in the new village areas as an additional effort to whiten the illegal factories.

Kampung Tunku recently visited to Kampung Baru Sungai Buluh. There are complaints from the landowner of the factory that they have financial constraints to extend the lease on their land. This happends beacause they have to pay higher premiums before they are allowed to extend their lease. At the same time, they have failed to get the bank loan to pay for the premium because the remaining leases period of less than 20 years.

This problem could be solved if the Government Land Ownership Scheme for Private Residential Buildings can also be used for industrial land where the government may charge a nominal premium of RM100,000 to enable them to extend the lease period and apply a loan from bank to pay the balance in installments.

Defamation against KSSB

Yesterday, we learned that the outcome of the sand during Barisan National is low because the state government at that time did not see the sand industry is an important source of wealth for the state.

This statement seems to say that Barisan Nasional government can not managed the source of wealth in Selangor until the industry may only contribute the royalty of not more than RM4 million every year to Selangor government. Now with clean and trustworthy of Pakatan Rakyat government, royalties paid out from the sand industry has now reached RM16 million a year. It should be noted that the profits of the sand industry has yet to reach the optimum level. It means this royalty still have potential for further improvements.

Selangor government under Pakatan Rakyat has established Kumpulan Semesta Sendirian Berhad (KSSB) to control the sand production from Selangor in a prudent and environmental friendly manner.

KSSB not only contributes royalties to the Selangor government. As a subsidiary of the Selangor Government, KSSB have to pay the dividends of profit to the Selangor government. KSSB also have to contribute to Merakyatkan Ekonomi Selangor (MES) programme and grant Selangorku. In short, the return of KSSB is the benefit for Selangor government and the benefit of Selangor government is the luck for the people.

Kampung Tunku was agreed with a suggestion from the Honourable Seri Muda yesterday that members of the State Assembly from Barisan National to be appointed for the Board of KSSB to enable them to understand how KSSB operates and avid to make any wild accussations towards KSSB. It is about time for the parties who had the political motive to stop any baseless accusation to KSSB. If they have proof, step forward to make allegations with evidence.

Honourable Member from Kuang also accused Selangor government did not buid any roads for the past four years. Kamoung Tunku conclude that the argument is not true and deflect the House because the answer is written in a question that I raised in year 2011 showed that the government spent RM630 milion to carry out the projects such as build a new roads, upgrading the old road, improving the hills slopes, repair bridges, widening the roads and other infrastructure works since year 2008 to 2010.

Once again, Kampung Tunku would like to draw Kuang attention to The Majesty speech in order all of us to discuss intelectually based on facts.

Yesterday, there was an uproar in the House because ADUN from Seri Muda exposed a scandal involving to our opposition leader and I quote a newspaper report which read as follows:

Winding up session for Selangor budget in year 2012 uproar due to the exposure to the Chief Minister on various abuse of power by Barisan Nasional Selangor involved the loss of million ringgit which also involved the opposition leader, Datuk Satim Diman

Besides Satim, Abdul Khalid also disclosed the acquisiston of land by former Chief Minister Selangor, the wife of Minister of Agriculture and Agro industry and local political leaders in order to own few lots of land in elite area.

In the winding up session, Khalid revealed the opposition leader; Satim Diman made a series of transaction related to the sale of land in Science Park 2 during BN administration

The particular land is state owned land that was given to the Selangor Agricultural Development Corporation (PKPS) for the science education.

According to Khalid (Chief Minister), the provision of land however sold by Satim in a cheap price to Nikmat Inai Sdn Bhd, where Satim is one of the shareholder and member of the Board of Directors.

Pending payment of purchase to PKPS, under his political power, the land was sold to Selangor State Development Corporation (PKNS) at a double price

This is how Barisan Nasional wasted money and natural resources of Selangor government. Compare to this scandal and cash reserves which increasing since year 2008, there is a certain significant difference. It is not wrong if anyone sayd Malaysia will bankrupt if BN is given a mandate to administer any of government in Malaysia.

Enough for people to suffer under the Barisan Nasional government, various scandals, corruption, cronyism, and mismanagement has always occurred under Barisan Nasional era. Until the 13th general election, Kampung Tunku believed Selangor people will not fooled by BN and with the grace of God, the arrival of 13th general election, BN’s life will cease at the same time.
